Poll question: Good Heavens: Judicial Watch has filed a lawsuit against the Senate
Do you remember Judicial Watch? They are the conservative legal organization that went after the Clintons for just about everything. However, they are currently going up against Cheney, but that's another story. Judicial Watch is suing the Senate (specifically) but mainly the Senate Dems for blocking the President's nominees.

Now, as far as I am concerned, they will lose this one because the Judicial Branch will show deference to the Legislative Branch. But that is just my opinion. What say you, the people of DU?

4. I honestly believed the SCOTUS would have deferred to Congress
during the 2000 election, as dictated by the Constitution, but I was mistaken. So, I no longer trust my opinion and must concede that I don't have a clue as to what the SCOTUS will do. It depends largely on the "moderates," O'Conner and Kennedy. All you have to do is ask them. The others will have a predictable response...probably.

Dammit! i just don't know!

5. Doctrine of political questions
They are not going to take it, and if they do they will probably give a opinion such that there is a right but not a remedy (if they don't decide in favor of the senate).

8. Also doctrine of sovereign immunity
The legislature is the repository of sovereignity and therefore sovereign immunity. No Senator can be called to account by anyone except the Senate for official actions taken on the floor of the Senate.

7. People elect Democrats to office in order to get a Democratic
voice in the Senate. The Democratic Senators were protecting the interests of their constituents...

Judicial Watch should stay out of it.

She has as much jurisdiction as any other court, which is none.
