1. Lay common sense needs better use of experts? as usual I need
time to absorb his comments that the experts are interested parties, so Courts should hire their own experts - maybe.

I hate it when someone tells me something that appears very logical, with which I agree, and then tells me that he is not quite there.

But then he tells me he likes the French system that does indeed use experts chosen by the court!

Then he hates bright lines - but in my previous work we always chased bright lines when screwing the system - meaning financial games would be harder under a Breyer world - and I rather like it.

But I suspect that is not about to happen in a GOP world.
