Prosecutor: Unseal Limbaugh's Medical Records
Prosecutor: Unseal Limbaugh's Med Records

December 19, 2003 10:43 PM EST

WEST PALM BEACH, Fla. - Rush Limbaugh's seized medical records are "relevant and necessary" to a prescription drug investigation and should be unsealed, a prosecutor argued in court papers Friday.

The conservative radio commentator has asked the court to keep the records sealed, saying investigators violated his privacy by seizing the records last month and that without them he cannot be treated for his medical conditions.

A judge will hear arguments on the issue next week.

Prosecutors are investigating whether Limbaugh obtained and used prescription painkillers illegally. No charges have been filed.

The records must remain sealed under Florida law unless the state shows a compelling reason to view them.

Prosecutors say the medical records support their allegations that Limbaugh went "doctor-shopping" for prescription painkillers. Search warrants list prescriptions from four doctors from March 24 through Sept. 26.

Limbaugh's attorney, Roy Black, has said the records show Limbaugh had legitimate reasons for taking pain medication. The attorney also said the prosecutor had political motives in pursuing a case against Limbaugh.

Limbaugh surprised listeners to his radio show in October by announcing he was entering drug rehabilitation. His announcement came days after news reports about the criminal investigation surfaced.

I did a Google and found that "Rusty" played in 18 celebrity golf tournaments this year, with many more slated for next year.

I have severe back pain, take Norco (hydrocodone) like they're M&M's, Soma (muscle relaxers) and there is NO WAY IN HELL I could play golf
with my condition (and it kills me because I love the game).

Rusty's concerned about his "treatment".

Another attempt by the hypocrites on the right to cover up the truth.

Don't the dittoheads smell even the faintest whiff of hypocrisy here?

4. These Drugs Weren't Prescribed!
This is what gets me...this whole story came to light as an on-going investigation into an illegal drug ring. What part of those words involve a doctor and doctor/patient confidentiality.

Limbaugh is the target in a criminal investigation of a federal crime...the illegal purchase of a controlled substance, period. This wasn't done by a doctor...and any attempt to legitimize Rush's supposed ailments while he was going out and buying illegal drugs is diversion and justifying ALL illegal drug activity.

There's a question about Doctor shopping and that's a serious and reasonable charge considering that Rush has admitted an addiction to the drug and has demonstrated he would go to extra lengths to procure it, legally or not. Thus these records could be more an indictment of a criminal enterprise than true medical treatment.

If Rush has such a bad problem, wasn't he examined during his rehab stay and if there was such a serious condition to require such large ammounts of medication, you don't think he and Roy Black wouldn't "rush" those out in the public ASAP?

The problem is Rush's drug problem is one of the few the RW morons really can't stomache. Sex, that's ok...larceny, fine...alcohol, cool, but drugs has always been a major no-no in Conservativeland...and Rush has to justify his "illness" or be completely tossed out by his own. This should be interesting to watch play out.

Isn't that what these pukes constantly say to us? Even regarding the overturning of the Sodomy Laws, thats all I heard - 'There is no Right to Privacy!'

Imagine that...hypocrisy from wingnuts. I'm so surprised. :eyes:

10. Damn right
That's what Rush said after the Lawrence v. Texas case, in lockstep with Santorum: there is no right to privacy in the constitution. In Santorum's words, he doesn't believe in the "right to privacy lifestyle" . But of course when Rusie comes along with his hillbilly heroin and his dangling jowls, the right to privacy is something to PROTECT, dammit!

14. what does it matter even if his back story is true?
all junkies are in pain - mental, emotional or physical pain. Republicans just like to think there's a big difference in what kind of pain.
