In the days of frivolous lawsuits,
e.g. the mcdonalds dummy who spilled hot coffee in her car while driving then sued because it was too hot... (try drving safely, you twit.)

e.g. the idiot who popped microwave with the plastic wrap still on... (no comment)

How come lil' George didn't sue that pretzel maker for choking on one?

1. The McDonalds "dummy" had severe burns.
Edited on Mon May-30-05 12:07 PM by Telly Savalas
The coffee was too fucking hot.

When I spill coffee on myself, the burns don't blister, nor should they.

This so called "frivolous" case is just fodder for conservative assholes who want to do away with torts, and hence corporate accountability. If the lawsuit was so frivolous, then why couldn't one of the largest corporations in the world get a legal team to convince 12 people that the plaintiff was full of shit?

Edited to add: sorry if this comes across as combative. Part of why this case gets brought up by the cons is because at face value suing McDonalds because you spilled coffee on yourself does sound really ridiculuous. It's only when all the facts of the case are known that it ceases to be frivolous. The problem is most folks never hear all of the facts of the case.

3. Not only that
but that particular McDonald's had something like 20 or 30 complaints before about the temp of their coffee and the woman originally only asked for her doctor bills to be paid. It went to court because McDonald's refused.

5. Yeah. It's foreseeable that coffee is going to get spilled,
especially inside a moving vehicle. When that happens, it shouldn't turn into a life threatening event. The woman sustained third degree burns. I don't think her lawsuit was frivolous at all, and neither did the jury.

6. The 80 year old's nylon panties were melted...
...by the 200 degree cofee she spilled on herself. She was in the frigging ICU for third degree burns.

I know one of the people who was on her case. The part that they don't mention is that prior to that point, McDonald's had a policy of heating their coffee to one degree below boiling so that it would stay fresh longer (which is bad), and this particular franchise heated it up even farther to prevent spoilage.

2. Have you noticed
that when the discussion comes around to frivolous lawsuits, about the only one that comes up is the McDonald's lawsuit? Oh, there are others and entire websites dedicated to examples. But the truth is, that frivolous corporate lawsuits against other companies and individuals far outnumber those by consumers.
