I live in a duplex. The other tenant is the niece of the owner. Peaceful enjoyment and other lease items specific to noise are merely suggestions. Her aunt defends her. "She's just a normal 27 year old." Okay, when I was 27, I didn't have parties until 4am or leave my dog (a terrier and dogs were NOT allowed in this building, but I guess since she's family...) alone all day and run home for 20 minutes to let it out and leave again until after midnight. Sunday night, the dog barked constantly from 10:45 when I went to bed, until 11:35 when one of both of the tenants got home. Then they play with the dog, running it up and down the stairs and hallway, both of which are common walls. I had an interview on Monday. I was exhaustd.
Fast forward to tonight. 2:45 am the roommate must have her Weimaraner over. It's full-grown but under 2 years old. It is NOT allowed, but since the owner winters in Florida and her niece is the tenant, I doubt the dog will have to go. The damn dog started barking and howling at 2:45 and didn't stop until after 3:30am. There was a lot of commotion over there trying to get the dog to be quiet, but it's not supposed to be there.
I'm going to the owner's sister's office (she's a realtor) and demand that she fax the letter I'm writing to her sister immediately. I'll also include the pages in the lease that specifically address peaceful enjoyment and noise.
I'm so tired of this shit. I would love to crank my stereo but don't, because I live in a multi-unit building and it's not allowed. But it's not about me, it's about the 20-something who will never grow up. Bitches.

She is still a legal adult, and therefore obligated to follow the terms of her lease. Anyway, as far as I'm concerned, 27 is old enough to have learned some respect for others. She's no teenager any more.

searching the internet for forms. Her aunt's (landlord) going to get two formal incident reports. I may be able to put my rent in escrow with the clerk of courts until she resolves this. And the landlord is a fool if she thinks ANYONE else would tolerate a barking 75 pound dog at 3:30 in the morning. Her question when I complained about the dog running up and down the stairs a few weeks ago? "Do you normally have trouble sleeping?"
I don't have the means to leave. I was saving for the move by working at the grocery store. When I lost my day job, now that's buying gas and food.

document EVERYTHING. Certified mail, photos, tape recordings. Keep a notebook with dates, times etc.
It makes a judges day in small claims court when you hand all of this stuff to him/her.

I love animals, but I wish something really bad would happen to these furballs.
Anyhows, call the Sheriff's Dept. They have a non-emergency line and someone will come over, check things out (especially good if tenant isn't home to quiet the dog) and make a report. Then you have the report to fall back on.
