Not only will I legalize all same sex marriages but I would make first time marriages (without kids) have an option to be like a lease that you can renew every so many years depending on you and your spouse's original agreement. Things don't work out down the road, don't renew the marriage. No harm no foul. You break the lease first, get caught cheating, being abusive, etc. you pay out your ass big time. Kids before the end of the contract would make it permanent. No more lease, your committed for the duration. Hopefully.

I would say that the child becomes the woman's and therefore the couple's child at the time of conception which is/was during the contract. Having verified from a well known expert, Mrs. DTW (hey, I can have cronys in my administration too), she said as soon as she knew she was pregnant, she called it "her" baby. But if there is no love in the relationship it would be wrong to renew or continue a marriage that is doomed to fail based on real statistics just for the child. It would be more emotionally painful for the child down the road if one parent leaves than if the child were born alone by one parent. Child support must be paid regardless. Even if the marriage is over the kids are still yours.
This may require more research and if you are interested in being the head of any advisory panel for this issue that I might create I'll give you first consideration for the job.
