Serious health insurance question |
The s.o. just got turned down for health insurance on the grounds of preexisting conditions (specifically generalized anxiety disorder and fibromyalgia), and polypharmacy (i.e. lots and lots of assorted drugs). I happen to think the underwriters are full of shit on this one, but I'm not sure how to build my case for a rebuttal, other than we have a certificate of insurability from the previous insurer (a change of jobs led to the s.o. getting dropped), and we've never filed any claims more serious than maintenance visits/checkups and drug benefits.
I am NOT looking for medical advice, just some way to convince these assholic beancounters that they're WRONG. Any ideas?

1. It depends on what state you're in I think. |
In some states it is against the law to deny insurance on the grounds of "pre-existing conditions..."

7. Texas, for some inexplicable reason |
I'll look into this, though. I'm not going down without a fight on this. It's absurd that the only people who can readily get insurance are those who don't need it/don't use it.

3. Does anybody know if this violates the ADA? |
Denying insurance this way clearly discriminates against people with disabilities, but it is legal or illegal under the American's with Disabilities Act?

4. Contact your state Board of Insurance immediately -- |
they can answer your question and when they get involved the ins. companies usually snap-to immediately. Good luck.

5. I agree with this approach |
Having worked in the insurance industry (as an accountant), the company will generally bend over backwards if the state makes a request of them. If they don't, they risk having the state make life miserable for them.

6. That's a good idea, thanks! |
I'll not hold my breath, since we're in Texas, but anything is worth a shot. :)
