2. He leaked classified information about the space program
and he is going to prison in a few weeks.

Sadly, the fictional White House staff is far less reprehensible than the real thing. Toby leaked the existence of a military-use space shuttle, when the civilian model was stranded in orbit and nobody at the White House wanted to divulge that information.

Edit: In response to the original question. Based on tonight's episode, I don't believe Toby would accept it, even if offered.

5. Yeah. the fiction is practically honorable
but gets punishment, while the real thing is vile and they got away with it.

7. Toby was present at the opening of the Bartlett library--
--at the beginning of the season...but there was a wariness in Bartlett's greeting of him, which made me suspect even then that Toby was the leaker...so he must be out by then...my guess is that Santos pardons him about a year into his administration...
