It's a way to emphasize a statement without pointing, which can be construed as rude, or making an actual fist, which can read as overly aggressive. The thumb-pointing thing is emphatic, but doesn't turn off juries. John Edwards, also a former lawyer, used it a lot, too, you may have noticed.
