I think this is legal. If I have an old scratched record, and I download an mp3 version of the same music, and sell the unplayable record second hand, and include a playable CD as part of the deal. Having a legal copy makes it okay. That's what I've heard, but don't know whether it's true.
The REAL question is whether ebay feels it's legal.
Same question for movies.

1. Not true. You can keep the CD, but not sell it. Making a copy for yourself is |

"fair use." Selling the copy is not.

2. You wouldn't want to make a CD from the mp3s anyway. |

3. It's a twisted version of the truth |

I only remember this because I wanted a CD real bad and it's real expensive online, so this one place says it will MAKE me a CD of the RECORD, if I also buy the SECOND HAND RECORD they made the CD out of. That makes it legal, may be the logic is you're getting a backup CD of your vinyl or something? (It's McKendrie Spring, Spring Suite).
So, if you sold someone a record, and also had a CD of the record, it would "appear" that you just recorded a backup CD for the person buying the record. Even if you did not. If you're worried about getting caught doing something illegal, do this one more illegal thing and your bu++'s covered! :headbang:
