Worst baby gift EVER....
in the Anna Nicole case, the judge just gave custody of the body to the baby (via her guardian ad litem), without saying what has to be done with it.

3 days of entirely wasted court time.

Make them dig her up if they want to. I'd think a court would be a bit more cautious about digging up a buried body.

Of course, one of the many insane freaks in this case will probably file an appeal. Meanwhile, ANS rots slowly.

12. It's the perfect decision
If he had given any weight to any adult over another, that would have carried into every other decision coming afterwards. Dannielynn is a valid next of kin and all the judge was asked to decide is WHO received the body - NOT where the body should go. He let everybody have their say and put everything out there, hear where everybody was coming from. Maybe they really will all come together for the baby from here on out. Would be nice.

legally it's the right decision. i don't understand why it took 3 days of testimony regarding the baby's paternity, Anna's drug use, Howard Stern's sources of income, etc. etc.

It appears the body will be returned to the Bahamas now. The parties came to agreement in half an hour.

If she concedes that the baby is next of kin now, then that means she concedes it on the money later. Right?

I really think this should not be on tv and don't really care. But since it's stuck in my face, the legal matters are interesting to me. I would have liked to have praticed law.

at least studying it. Not sure about practicing it.

As for being on TV, I'm of two minds. On one hand, it's a public proceeding, AND it's interesting. On the other hand, I think it's a shame when lawyers pull pranks like one did today where she read Burkhead's email address live on TV. It would be nice if there were some way sanction lawyers who pull stunts like that.

It seemed to me it had to do with whether she had made her wishes known and whether Stern had her confidence in making these decisions for her. Was he an abuser who had kept her isolated and drugged? If you're trying to decide whether Stern should be considered a spouse, whether it mattered where Dannielynn was going to live, whether she had reconciled with her mother, all kinds of things. I think he was a very strange judge, but considering the amount of money and those motivations, I think he was right to be very careful in this decision.

Aargh, the mom is going to appeal. What a shame. *sigh*

17. It's my understanding
that Anna's wishes are essentially irrelevant. The body becomes property.

I guess the decision is who is next of kin - the mother or the daughter? I would assume states have laws defining the heirarchy, and I presume a child inherits before a parent.

I missed one part - who appointed a guardian ad litem for the baby? Stern was the executor of the estate, and presumably (at least in the Bahamas) the "father of record". Did Burkhead sue to have a guardian appointed?

23. Her wishes are not irrelevant -
essentially the decision was whether she had made her wishes clearly and credibly known, or would the body go to the next of kin.

As far as a GAL for the baby, I don't know for sure, but I'm guessing that when paternity is in question and the mother is incapacitated (or in this case, has passed away), a GAL would be standard. I don't know who appointed one for her.

24. I didn't understand it that way
I understood it that her wishes would be first, if they were legally stated. If she had a recent will that was above reproach, and it had said Stern makes all the decisions, then that would have been the end of it. That wasn't there which is why it was open for decision. As I understood it. I think the judge just appointed the guardian which is done almost any time a child has interests at odds with a parent or custody, etc. I think he did a good job laying the groundwork for the rest of the case.
