At this time tomorrow I'll be in my unemployment hearing
which will determine if my ex-employer is allowed to lie and totally screw me out of unemployment compensation, i.e. not collect any more and pay everything I've collected so far back to the state.
If that happens I will be in deep trouble.

I am meeting my law student volunteer late this afternoon- he will be with me tomorrow.

I know people go through worse things than this all the time, but for me this is huge, so please send me some good vibes or prayers, and/or send the HR VP some extremely bad ones.

They brought 4 people and it lasted 2 hours. The judge was good and the lies were flying. I do not have confidence that things will go my way, I just don't know. My law student just didn't say much. The HR VP was a total asshole. The guy who was my supervisor & friend came to lie about me. I will dread going to the mailbox every day... I need a job real soon.

So please keep do your fingers crossed! Some parts went well (like the accusation of misconduct) but because they went over so much stuff, some new issues were opened up that might not be in my favor. So I just don't know, and while I'm glad this part is over, I really don't feel any better.

27. If its bad news I don't know what I'm going to do
I will have no income and no way of paying this money back. I honestly have no idea what to expect. Some things seemed to go well, other things didn't. Its really hard to be objective, and its really hard to tell what the judge knows. The burden of proof is on the employer. The employer also has the power to bring in employees and coerce them to lie- and the judge knows it.

Several pieces of factual information that my co-workers and I testified to was exactly opposite each other. So, somebody is lying. It was awful having my supervisor, who used to be my friend, deny he was my supervisor, lie about me, and make up stuff about me. I'm glad its over but I really don't feel any better.

It happened to me as well.

Five times I had to prepare for hearings, my employer NEVER showed up. Apparently it often happens as they want to scare you.

The 6th time the court said: Enough!! I got my unemployment :woohoo:

I am sure it will happen to you as well.

31. My employer is an hour away and 4 people were there 45 min early
They were there before me and the law student. Four people with salaries over eighty thousand dollars took half a day off to screw with my life. I would have been thrilled if they didn't show up. If they win I will appeal, and I am afraid this will go on and on forever.

The judge seemed like she knew bullshit when she saw it. She called the HR VP on his crap many times.

and we live in town. I didn't even get to talk until 45 minutes into the hearing. And various people kept throwing in unrelated stuff to "trash" me. It was like having your brothers and sisters yell "Hey MOM, She did THIS!" just because they had the floor. But they looked like idiots. I didn't do it to them.

My law student didn't lose his cool. I got agitated when the HR asshole kept asking me the same stuff over and over... He turned off my user rights at 4pm but he wanted to make a federal case out of it that I left the office at 4pm, which we often did on Fridays anyway. So he asked me that about 10 different ways, like I'd hidden WMDs or something.

32. Some employers contest unemployment compensation as a matter
of course. Another young woman and I were fired on the same day. The employer tried to insinuate that we were both guilty of stealing money from the company.

Although we worked in different departments, we both knew the routine for each other's department and vouched for each other and the procedures which the employer tried to use as evidence.

The manager of the store had to admit that there was no evidence against either of us.

I contended that I was fired because I was pregnant and the the other young woman was fired because she had two minor children (she was on maternity leave when the company took over our store).

The hearing officer dicounted the employer's suggestion that we were theives (I had worked for the store for ten years to the day and she had been there for about six months more than me.)

He also discounted my testimony regarding the attitude toward my pregnacy and others with minor children.

We both got our unemployment compensation.

And with in less than eighteen months, all employees with minor children were out of jobs. They were either transferred to on call traveling positions or harassed to the point that one just threw off her smock and stormed out the door.

An assistant manager who worked from Friday afternoon at 1:00 p.m. to Monday afternoon at 1:00 p.m. would get home only to be called back to do menial things like cut down the boxes in the box room.

The only people left working in the store were part-time teen agers, people with no children, and people whose children were over twenty-one.

34. They turned off my network access and I am a computer tech
so I assumed that meant I was fired. My email account was shut off. They didn't tell me I was fired. Then I called in sick. My supervisor wouldn't return my phone calls. One day I just didn't go to work. The next day I got a letter of dismissal. They intended to terminate me the day that they turned off my computer rights but apparently they missed me- so I was still considered an employee... they didn't call me and I didn't call them.

Finally I called the corporate headquarters of the parent company and asked what my status was. All the people in Human Resources were bizarre liars who I didn't trust, so I saw the whole thing as head games. Now I'll have to see if a judge sees it that way.

If I can help it, I never want to deal with a Human Resources person again. I'd rather have sex with Dick Cheney.

37. My ex was fired for stealing
He was accused of stealing and the manager said it was witnessed by another employee. The manager refused to name the witness and my ex at the hearing declared that he had a right to face his accuser. He won!!

P.S.My ex worked at a gay porn store and closet cases will get rid of the evidence in the parking lot before they go home to their sweet, darling, wifes. Stuff like dildos,lube, poppers,movie pass, etc. My ex used to patrol the parking lot, gather this stuff up and resell them and pocket the money. This is why he was fired but the manager wouldn't name the guy who witnessed it, so he lost.

40. You would not believe the time spent today discussing the nuances
of the Microsoft Outlook Calendar and the appointment which I was accused of opening- this being my most grievous misconduct which made me worthy of terminating immediately.

What's interesting of course is that they fired me without ever even confronting me with it (the person whose calendar it was simply misunderstood me) or giving me a chance to defend myself. So at the hearing I was completely non-defensive. I just said no, I didn't do that. And that was it. They fired me and made up this grievous misconduct and never even talked to me about it because they love to sneak around and treat you like a criminal and they're so self righteous.

Good honest employees aren't all that easy to come by, especially at retail jobs, so if somebody is dumb enough to fire an honest person, they don't deserve them anyway.
