On Howard Stern this morning, he was referencing a recent Oprah Winfrey where she and her guests were talking about sex....more specifically new buzzwords and what kind of sex they refer to (the words oral and anal were used). Howrad wanted to play the Oprah clip...to try and bait the FCC. Do they fine him and not Oprah? Would the FCC DARE to fine Oprah? The backlash... Unfotunately the station GM wouldn't let him air it (actually bleeped it out) so we won't know THAT question. But the question remains...what is the difference between what Howard said (that got him fined) and what Oprah said (bet you a kajillion dollars she ain't getting fined)?

Laura Ingraham is a conservative pundette who does a radio show which is carried by a number of Clear Channel radio stations. Last September, Ingraham and her sidekick Lee Habeeb were on-air talking about CNN personality Tucker Carlson's interview with Britney Spears. And Lee said "Did Tucker get to fuck her?".

The FCC - The FCC vs Pacifica (1974) pretty much limited "indecency: to seven words. Cut to Mr. Carlin. And after that, the FCC is pretty much a mystery.There are no other rulings that would indicate what Stern said was fineable. And if it is, why not the others? I remind you that the FCC is headed by Colin Powell's son.
Clear Channel - See Above. Laura Ingraham is a Clear Channel talk show host. Her sidekick said "Did Tucker get to fuck her?" (I believe the FCC complaint against Stern is based on what a caller said. Where is the punishment? And I remind you that Clear Channel is a huge and vocal Bush supporter (orderd stations to not play Dixie Chicks after they criticized Bush, "reassigned" dj's for the same) and has close ties to the FCC.
Am I crying conpiracy theory? Perhaps. My main issue is with the nature of the cozy relationship the FCC has with large corporate media companies like ClearChannel. For a few years now, the FCC has been moving to privatize the airwaves, basically selling off (permanently) frequencies to the highest bidder. So it would make sense that the larger corporate owned media outlets would be the only ones who could buy them. And the FCC would be "protecting the public" be seliing to "responsible" outlets who wouldn't broadcast "indecent material".
If we agree that the media needs to be held accountable, then we should also agree that those doing the accounting need to also act in the public's best interest and their processes must be both transparent and accountable to Congress.
