A recently passed resolution that prohibits guns in municipal parks cannot be overturned through a referendum, Oak Ridge City Attorney Ken Krushenski said Monday.

The question came up after Oak Ridge resident Alex Moseley, a recent candidate for political offices, announced that he has mounted a petition drive to overturn the resolution. Under that resolution, approved through a 5-2 vote last month, the Oak Ridge City Council "opted out" of a new state law that allows gun permit holders to carry their weapons into local, state and federal parks.

"There is no legal provision for a referendum on that issue," Krushenski said. "It's got no legal authority to get on the ballot."

Moseley said a recall of City Council members might be considered if voters are not able to cast ballots in a referendum on whether to allow guns in municipal parks, a question that has sparked much public debate.

"The issue is in no way dead," Moseley said, adding that a growing number of people are volunteering to help him and there are more than 1,000 local gun permit holders.

1. Bad move on the state legislature.
If they didn't have the votes to pass it without the opt out clause then they shouldn't have passed it. Cities routinely touch other cities and having the law vary from street to street is a recipe for disaster.

State preemption and uniform policy across the state.

I give bad marks to the state legislature despite passing a pro-RKBA statute they did it in a very poor manner.
