Missouri CCW injunction: implications for police
I read that the Missouri CCW law (which was passed by the legislature by overriding the governor, and which by the way went against the will of the people in 1999) has been put "on hold" via an injuction from a state judge. I believe the judge ruled that the CCW law conflicts with the Missouri constitution, which says that the right to bear arms does not justify the wearing of concealed weapons.

So far, so good. But, what is the effect on police officers who wear concealed weapons (e.g. undercover or plainclothes officers)? Technically must they now too disarm?

I bet police and Federal agents will continue to carry concealed. What do you think this injuction is going to do to the criminal element in the state? Do you think they will stop carrying concealed?

2. I doubt it.
I'm sure the law is applying to "civilians", not law enforcement officials.

The people of Missouri turned down Concealed Carry at least twice, maybe three times in the last several years.

3. The Judge Is Following the Law AND The Will of the People
Rather than bowing to the will of the gun lobby, like the GOP has and some pro-gunners want the Democratic Party to do as well.

I know that becasue of the lack of a conceled carry law in MO, there are NO criminals what so ever packing heat right now. Sure is a good thing to know that laws do work.

It doesn't make ME feel safer not knowing if the assholes I meet every day may be packing........

And we have more than our share of right-wing assholes here in Colorado.

The assholes I'm talking about belong to groups like the John Birch Society, the Rocky Mountain Firearms Coalition, and the Gun Owners of America. They flood local talk radio here in Colorado with their gunpowder-induced bravado, and talk about "taking back the government".

THOSE are the assholes I'm afraid of. Because they all have guns. Lots of them. And I don't think they'd hesitate to use one on another person - especially a "damn liberal".

I see there are issues here other than just Guns,
I lived in NYC and was robbed many times, and it was not by any of
those Guys, and I doubt They are after Liberals or Jews,
the Gangs today do a good enough job on both as I can tell

6. Which law is the judge following?


It makes sense to say that a person can not claim a right to concealed carry under the provision cited, but how can one conclude that cancealed carry is forbidden by that provision? Or that the legislature can not authorize concealed carry?

Is there some other provision in that states constitution that the judge is relying on?
