GUNS IN THE NEWS--July 15, 2004
As CO Liberal sez:
Please try to adhere to the following voluntary guidelines, in order that we can have an orderly discussion of gun-related news topics:
1 - Feel free to add any CURRENT stories to this thread by replying to this message. In order to be considered current, stories should have been originally posted on the Internet within the previous 24 hours, or provide follow-up to a story that was previously posted on the J/PS board. EXCEPTION: On Mondays (since many people do not log in to DU over the weekend), stories can be posted from Saturday, Sunday, or Monday.
2 - Both pro-gun and anti-gun stories, editorials, and press releases are welcome in this thread, as long as they're current. Please do not post links to items from a few years back that support your position.
3 - Bear in mind that any links to extremely right-wing sites (such as Newsmax, CNS, or the Washington Times) or intentionally pro-gun or pro-control sites (such as the NRA or the Brady Campaign) are not considered reliable sources by many DU-ers. If at all possible, try to find a link for your story from a more mainstream source, such as a general-circulation newspaper or magazine site. If you choose to use a slanted site, be prepared for any negative feedback you may receive.
4 - Please try whenever possible to provide links to web sites that do not require you to subscribe to the site to read the story. If a subscription site is the only source you can find for a story, please note that fact in your message so people can decide whether they want to follow the link to read the entire story.
5 - Do not change story titles. In other words, if the Oskosh Gazette's web site runs a story titled "Two Killed in Holdup", the title of your message should read "Two Killed in Holdup". Don't change it to "Gun Owner Kills Two People", or anything else that changes the meaning of the story.
6 - If it's not clear from the title where the story occurred, add the city, state, or country in parentheses after the title.
7 - The person adding a news story to the "GITN" thread is allowed (and encouraged) to comment on that story, indicating their position on the topic being discussed. These comments can appear either at the beginning or end of the post; if possible, place comments in a different typeface so readers can separate the comments from the story. Others who wish to comment on a posted story can do so by replying to that story; this allows other readers to follow the comments by scrolling through the subthread.
8 - Please direct your comments to the story, rather than attacking the person posting the story or any person responding to the story. In accordance with DU rules, any message that appears to be a personal attack against another DU-er or a violation of any other DU rule will be reported to the moderators.
9 - If you object to these guidelines (or the basic concept of the "Guns In The News" thread), do everyone else a favor and go to another thread.

1. Man shot after he allegedly fires gun (CA)

"A 29-year-old man was shot by sheriff's deputies early Wednesday after he fired a gun at them while they were responding to a disturbance at his house north of Ventura, authorities said.
Jed Temple was shot in the leg and arm about 12:30 a.m. near his home at Norway Drive and Bounds Road, in the North Ventura Avenue area. Temple is expected to recover and face attempted murder charges. "

2. CIA contractor's guns taken from girlfriend's home (NC)
"The same day a federal magistrate denied bail for a former CIA contractor accused of beating an Afghan detainee who later died federal agents searched his girlfriend's home and seized guns, cash, and computer equipment, according to search warrants.
Officers combed through the apartment of the girlfriend, Bonnie Heart, hours after she testified she collected firearms from David Passaro's home the night he was arrested.
Passaro, 37, a former Green Beret who went to Afghanistan under a contract with the CIA, was indicted June 17 on charges of assaulting an Afghan detainee during two days of interrogations in June 2003. The detainee, Abdul Wali, 28, died the next day.
Heart, a Wake Forest police detective, testified at a detention hearing June 25 that Passaro had asked her to retrieve cash hidden in his Lillington home. At the hearing, evidence and testimony suggested that Passaro had aliases, hidden assets and a possible escape plan."

Why, the very same people who'd have ALL the guns if we lived under British-style gun control.

The fact of civilian gun ownership is not by itself enough to keep oppressive governments from rising -- granted. But does anyone really think that the state would treat us better -- respect us and our rights more -- if we were disarmed?

if you hadn't referred to "British-style gun control."

But in any case, my point was/is that two countries very much like the US in a lot of ways have strict gun controls, "British-style" gun controls in fact, and they are not fascist states. Less fascist than the gun-happy US, at this point in time.

"HPD homicide detectives are investigating a double shooting in northwest Houston that left one person dead and another in critical condition.
Shots rang out early Thursday morning at the Perfect Rack Pool Hall and Bar near Mangum and Dacoma. The shooting happened outside the business which is located in a shopping strip.
The parking lot in front of the club was littered with shell casings and now the investigators' orange cones mark their location. "

The victim of a shooting Tuesday afternoon in Crofton apparently was shot multiple times after he was caught burglarizing a home by one of its occupants, Anne Arundel County police said yesterday.

Police had not released the name of the victim, whom they described as a 40-year-old white male. He was taken to Maryland Shock Trauma Center and was in serious but stable condition yesterday morning, police said in a news release. An updated condition was unavailable yesterday evening.

Police said the man was suspected in several other burglaries in the immediate area but that he had not been charged.

At the conclusion of the investigation, the state's attorney's office will determine if the shootings were justified, police said in a news release.
Would that be "justified" as in "committed in self-defence", or does this state allow people inside other people's homes to be shot on sight?

Police said the man was suspected in several other burglaries in the immediate area but that he had not been charged.
Gosh, and nobody'd been killed or even hurt in the process, either, it seems.

So, was it justified assault (still possibly homicide, given the condition of the person shot), or attempted extra-judicial execution?

I'll be staying tuned.

"On July 2, Fairfax County police received a 911 call from a Champps restaurant in Reston. Six men are seated at a table, the caller said. They're all armed.
Dispatchers quickly sent four officers to the scene. The officers were "extremely polite" and were hoping that some of the men were in law enforcement, said Sgt. Richard Perez, a spokesman for the police department. None was.
The men told the officers "they were just exercising their rights as citizens of the commonwealth," Perez said.
"This just shows you the extreme nature of what they're trying to do," said Bob Ricker, head of Virginians for Public Safety. "You don't want to go to Starbucks or Reston Town Center and see somebody with a firearm strapped on," he added, referring to two locations where armed patrons were found. "It's just something that I think is completely unreasonable. We all understand the concept of self-defense. . . . But when you're talking about Fairfax County, you have to look at what is reasonable." "

"A man charged in the robbery-murder of a pizza deliveryman two years ago said he had to shoot because a partner mentioned his name during the robbery, a prosecution witness testified Wednesday.
The testimony of Eronia Neal, who was then 14, conflicted, however, in several details with the statement he gave police after his arrest in the robbery and murder of John Stambaugh.
Defendant Louie Holloway, 23, is charged with first-degree felony murder while Neal is charged with a lesser offense similar to aiding and abetting.
The case against Holloway is expected to go to the Criminal Court jury today. He faces life in prison if convicted as charged.
Neal and a third defendant, John Rolando Green, 21, who also is charged with felony murder, are awaiting trial. "

"NANTICOKE - Homicide suspect Wayne Adams "emptied the clip" of six or seven bullets from an assault rifle into Adam Martin, sending him to the ground, a trooper testified.
But Adams, 25, noticed Martin's chest was still moving as he gasped for air.
Then, Adams loaded a 12-gauge shotgun with a single shell and fired one last shot into his longtime friend from about 3 to 5 feet away, state police Cpl. Leo Hannon testified Wednesday.
The corporal said Adams told him about the June 19 killing hours after the body of 46-year-old Martin was found at the bottom of an embankment in a wooded area of Newport Township."

"(7/14/04) 16-year-old Eric Martinez was found lying in the driveway of a home on Josephine, with a bullet wound to the head, just before midnight.
Police discovered the body, with a gun lying next to it, after neighbors called, reporting multiple gun shots in the area.
A short time later, police also got a call about another shooting victim at St. E's.
22-year old Dewayalyn Colvin was dropped off at the hospital with five gunshot wounds. He's in stable condition. "

Albany police said the boy claimed he found the gun in a lot across the street from the Livingston Food Market.
The boy is on probation for previous assault and weapons possession charges.
Police searched a Second Street residence and found a loaded .357 handgun in the mother's closet, wrapped in a sweatshirt. The boy told police he found it on Saturday, and that he hadn't used it. "

A day earlier, Antigone "Mona" Allen had decided to give her estranged boyfriend, Genaro Remigio Garcia, one more chance. She'd left him a month before, tired of the bruises and his controlling ways.

So when he pulled up at her mother's house in Parkland, Pierce County, late Tuesday night, 18-year-old Allen packed their three sleeping children in the back of his Lincoln Town Car, expecting to go home.

She awoke to see him snorting coke, something she'd never seen him do before. He pulled a .45-caliber pistol and pointed it at her head. He grabbed the gas can and splashed himself, Allen and their children — Christine, 2 ½, Kristian, 18 months, and Adam, 6 months — and flicked a lighter.

The car burst into flames, careened off the road and flipped over in a dark pasture. The children, trapped inside, died at the crash scene. Allen staggered from the wreckage, engulfed in flames. Garcia followed, also on fire, and began shooting at her as she screamed and ran across a field. Garcia walked and fired until the gun jammed and fell from his incinerated hands, according to police. He collapsed, and arrived dead at Harborview Medical Center in Seattle.
