GUNS IN THE NEWS--July 16, 2004
As CO Liberal sez:
Please try to adhere to the following voluntary guidelines, in order that we can have an orderly discussion of gun-related news topics:
1 - Feel free to add any CURRENT stories to this thread by replying to this message. In order to be considered current, stories should have been originally posted on the Internet within the previous 24 hours, or provide follow-up to a story that was previously posted on the J/PS board. EXCEPTION: On Mondays (since many people do not log in to DU over the weekend), stories can be posted from Saturday, Sunday, or Monday.
2 - Both pro-gun and anti-gun stories, editorials, and press releases are welcome in this thread, as long as they're current. Please do not post links to items from a few years back that support your position.
3 - Bear in mind that any links to extremely right-wing sites (such as Newsmax, CNS, or the Washington Times) or intentionally pro-gun or pro-control sites (such as the NRA or the Brady Campaign) are not considered reliable sources by many DU-ers. If at all possible, try to find a link for your story from a more mainstream source, such as a general-circulation newspaper or magazine site. If you choose to use a slanted site, be prepared for any negative feedback you may receive.
4 - Please try whenever possible to provide links to web sites that do not require you to subscribe to the site to read the story. If a subscription site is the only source you can find for a story, please note that fact in your message so people can decide whether they want to follow the link to read the entire story.
5 - Do not change story titles. In other words, if the Oskosh Gazette's web site runs a story titled "Two Killed in Holdup", the title of your message should read "Two Killed in Holdup". Don't change it to "Gun Owner Kills Two People", or anything else that changes the meaning of the story.
6 - If it's not clear from the title where the story occurred, add the city, state, or country in parentheses after the title.
7 - The person adding a news story to the "GITN" thread is allowed (and encouraged) to comment on that story, indicating their position on the topic being discussed. These comments can appear either at the beginning or end of the post; if possible, place comments in a different typeface so readers can separate the comments from the story. Others who wish to comment on a posted story can do so by replying to that story; this allows other readers to follow the comments by scrolling through the subthread.
8 - Please direct your comments to the story, rather than attacking the person posting the story or any person responding to the story. 1. Couple dead after 19-hour standoff (FL)
"(Pinellas Park-AP) -- A boat salesman and his wife are dead after a 19-hour standoff with a SWAT team in Pinellas Park.
Officials say Maurice Whiteman and his wife Karen were found in the same bed at an EconoLodge yesterday. He was already dead, then she died later at a hospital. Each had a gunshot wound to the head.
The standoff began Wednesday after authorities received an anonymous tip that Whiteman was at the motel with his wife. He was wanted on charges of violating probation stemming from a 2002 grand theft charge.
While on probation, he tested positive for cocaine and was arrested this year on another grand theft charge. While talking with hostage negotiators, Whiteman insisted he didn't want to go to prison, worried he would be there for 25 years. "

Triple Shooting in James City County Leaves One Man in Critical Condition

Three people were injured Thursday afternoon in a shooting in James City County - and officials are still searching for the gunman.

The three were shot in an apartment complex in the 4000 block of Grand Strand Drive around 4:45pm.

One victim was an innocent bystander who was in his apartment downstairs. Police say a bullet came through the apartment and struck the resident. He was not seriously hurt.

A second victim, 25-year old Brain Braxton, was airlifted to Sentara Norfolk General Hospital. Braxton is listed in critical condition.

Highway shooting suspect competent for trial

COLUMBUS, Ohio (AP) -
A man charged in a series of highway shootings around central Ohio is competent to stand trial despite suffering from paranoid schizophrenia, according to a psychiatrist.

In a sworn statement filed Thursday, Dr. Mark Mills said Charles A. McCoy Jr. has had the illness for at least 10 years and requires medication "to achieve and/or maintain competence."

McCoy, 28, has pleaded not guilty to a 24-count indictment including the fatal shooting of a 62-year-old woman in November. She was the only person hit in the attacks, which occurred mostly on or around Interstate 270 in Columbus.

Although medicated, McCoy understands he is charged with several serious crimes and is able to communicate with his lawyers and help them in his defense, Mills said.

4. Police identify Pine Lakes man found dead (FL)
"Authorities have identified a man found dead in a Pine Lakes bedroom and are treating the death as a homicide, Lake County Sheriff’s Office public information officer Lt. Todd Luce said Thursday.
The body of Bennie Dyer, 68, was discovered Wednesday inside a house which showed signs of forced entry, according to Luce.
Luce said the person who found Dyer testified as to not having seen him in two days. He said police estimated Dyer had been dead at least a day.
Medical examiners reported Dyer had an apparent gunshot wound to the head from point-blank range and severe head trauma, Luce said.
“They don’t know how many times he was shot,” he said. "

Man, woman found shot in home on Northside

July 16, 2004


Indianapolis police are looking for clues in an early morning shooting Thursday that left a man and woman badly wounded on the Northside.

Indianapolis Police Department Lt. Paul Ciesielski said the shooting occurred about 1:30 a.m. in the 2800 block of North Temple Avenue.

Police received a call about a person shot. When officers arrived, they found Terry Easler Jr., 27, inside his home. He had been shot several times.

During a search of the home, police found Lakisha Cannon, 23, in another part of it. She also had been shot.

SUNNYSIDE, Wash. --
The body of a shooting victim has been found in an irrigation canal near this lower Yakima Valley town, Yakima County sheriff's deputies said.

Workers from the Roza Irrigation District discovered the body of Ignacio Cervantes Cisneros, 54, of Sunnyside, shortly before 11 a.m. Thursday, according to a news release issued by Lt. Stewart Graham.

Cisneros, last seen by relatives the previous Friday, had been shot once in the chest, Graham wrote.

THE WASHINGTON POST


Police in suburban Fairfax County, Va., received a 911 call from a suburban Champps restaurant July 2. Six men are seated at a table, the caller said - all armed.

Four officers quickly arrived. They were hoping that some of the men were in law enforcement, said Sgt. Richard Perez, a spokesman for the police department. None was.

The men told the officers "they were just exercising their rights as citizens of the commonwealth," Perez said.

Turns out carrying a pistol in public is perfectly legal in Virginia. And three times in the past month, residents have been seen out and about in the county, guns strapped to their hips, exercising that right.

8. One Gun-Related Story I Decline to Post At This Time
I just saw something on Google about how the Gun Owners of America (GOA) want to meet with John Kerry to discuss the gun issue. Unfortunately, there were only two sources for that story - CyberCast News Service (CNS) and NewsMax. Since these sources are ultra-right wing and totally unreliable, I will hold off on this story until I see it carried by a more reputable source. - Wayne

HAFB officer allegedly fired gun near club

A security officer tasked with guarding the gates at Hill Air Force Base has been placed on administrative duty for allegedly firing a handgun during a disagreement outside of a Salt Lake City nightclub.

Donta Smith, 24, allegedly fired three rounds into the air from his .45-caliber handgun early on July 2 while he was riding in a Lincoln Navigator. The Navigator was involved in a car chase with another group at 1:50 a.m. following an argument at Club Utopia. No one was hit by the rounds.

Capt. Sean Carter from Ogden Air Logistics said the gun was not issued to Smith by the Air Force.

Smith is a senior airman with the 75th Security Forces Squadron and has served in the Air Force for a little more than five years.

A 24-year-old Easton man was arraigned Tuesday on weapons and other charges after he was found to be the owner of a sawed-off shotgun, court records say.

Police were questioning a man just before 10 p.m. July 8 outside a convenience store when they spotted Dale Michael Glover and another man staggering near heavy traffic at the intersection of Freemansburg Avenue and Paul Street, records say.

The officer suspected the men were drunk and stopped them for questioning. After the men admitted to drinking, police administered a breath test, which revealed the men's alcohol level was greater than that allowed for drivers in Pennsylvania. They were then cited for public drunkenness.

After issuing the citation, police asked the men to call for a ride home. When their friend arrived a few minutes later to pick them up, police asked to search her car. After receiving permission, police found a 12-gauge sawed-off shotgun with its serial number scratched off in a backpack along with a sock stuffed with four shotgun shells, records say.

At least two Central Minnesota sheriff's departments have modified their procedures because of a judge's ruling that questioned the state's handgun permitting law.

Morrison County Sheriff Michel Wetzel said he's asking those seeking a permit to go ahead with the required training course, but to hold off for a month or so in seeking a permit. The reason is the uncertainty about what's going on with the law, he said.

Benton County Sheriff Jim McMahon is offering similar advice. His department is taking the names and numbers of those who are applying for permits and plans to call them back when the law's status is sorted out, he said.

A Ramsey County judge this week ruled the state's handgun permitting law is unconstitutional. The decision came in response to a lawsuit filed by churches and religious groups.

Norton's wife, whose name was not released, was treated for an arm injury at Danville Regional Medical Center and released.
Goodson said Norton held his wife hostage for about an hour before letting her go and turning the gun on himself. Officers negotiated with Norton for about three hours before he surrendered. "

"HOLLIS, Maine — Two young men were shot to death early Friday in this southern Maine town in what authorities labeled an apparent murder-suicide.
The shootings at a single-family home on Route 35 were reported to the York County Sheriff´s Department in a 911 call around 2:45 a.m.
"We´re investigating this as a murder-suicide," said Stephen McCausland, spokesman for the state Department of Public Safety.
The men, one from Biddeford and the other from Hollis, were in their early 20s. Their names were being withheld pending notification of next of kin, McCausland said."

"A Delray Beach teenager pleaded guilty Thursday to firing a rifle into a crowd in January.
His fate now lies with Circuit Judge Hubert Lindsey, who can choose to sentence 17-year-old Michael Levine to anywhere from six years to life in prison.
Levine pleaded to attempted second-degree murder, shooting into an occupied building and discharging a firearm from a vehicle. On Sept. 3, Lindsey will hear testimony from the state and the defense before announcing his decision."

PACIFIC BEACH – A man who was at home with his wife and young child shot an intruder trying to break in early yesterday, police said.

The man was trying to get in through the front door of the home on Hornblend Street near the Mission Bay Golf Course about 1:52 a.m. The resident shot at the man, hitting him once in the ankle. The intruder ran away, but police soon found him.

They took the man to a hospital and then to the county jail.

May 29, 2004 - Prosecutors say they will not charge a man who shot and killed an ax-wielding intruder in his bedroom.

Prosecutor Druanne White says Lance Myers, of Anderson, acted in self-defense when he shot Ernest Leroy Miles, 41.

Myers told police he shot Miles in the neck after spotting an intruder coming at him with an ax on March 7th.

White says the evidence in the case lined up with Myers' story.

23. Homeowner Thwarts Break-In Try (MS)
A man who attempted to break into a south Jackson home on Tuesday left the car he was driving running in the homeowner's driveway as he fled.

But that wasn't the only error in his bungled attempted burglary at 1789 Shady Lane Drive. The first was trying to break in as the family was watching television, only to be stopped at the door by the homeowner.

"His eyes got mighty big when he saw what was waiting on him," said homeowner Edward Blair, a security guard with Wright's Security Service, who grabbed his .38-caliber revolver and stood patiently in the kitchen near the front door after hearing a racket about 1 p.m.
The door cracked, from the impact of the kicks, and the man stuck his head through to peer at what he could loot.

"A San Francisco supervisor has quietly introduced a proposal to join growing efforts to ban the sale or transfer of high-powered sniper rifles, prompting gun lobbyists to threaten a lawsuit against The City.
Supervisor Matt Gonzalez's plan is part of a growing legal pressure against the military-style .50-caliber weapons that are capable of penetrating armor and striking targets up to four miles away. A gun-lobby lawsuit is proceeding against Contra Costa County for its recent ban of the rifles in unincorporated areas of that East Bay region.
U.S. Sen. Dianne Feinstein has worked for years to curb the .50-caliber's prevalence, and a spokesman from her office said she would be supportive of a local effort.
"We've tried to limit them on a national level and we haven't been able to get that through," said Howard Gantman of Feinstein's office.
Contra Costa supervisors passed a ban on the rifles this spring, arguing that they might be used for terrorist attacks on local refineries. The City of Los Angeles has a similar ban, and these efforts to restrict the guns are now working their way through state and federal legislatures."

In the Contra Costa lawsuit, the gun nuts sued under first amendment grounds...do you suppose they forgot about that claim that they had a right to their ugly little toys under the Second Amendment? That's an orange because what it's actually referring to is the longest recorded successful striking of an human intended target. If the shot hadn't hit the intended human target, do we have any reason to believe it wouldn't have gone on to hit something or someone considerably farther away?

The record set was for a "kill", which I take to mean the hitting of an intended human target -- since the first shot, in which the bullet struck something being carried by that target, didn't count for the record. It certainly does prove that things can be hit at that distance though, and yet not be counted in our "orange" statement above.

If the target were a barn, might it be rather easily struck from four miles away by someone with the same skill as the person who could strike a person at 2430 metres (2657 yards, or ~1.56 miles)?

If the target were person A at 1.5 miles, but the bullet missed and hit person B at 4 miles, is the "apple" statement above false?

Only if the statement must be interpreted as meaning "striking intended targets up to four miles away", and only if we are assuming that someone could not strike any intended target, regardless of size, at that distance.

I don't think it must be interpreted that way, but I don't know for sure whether it is false if interpreted without those conditions.

Resident describes robbery that led to fatal shooting


James Burnett was taking a shower Wednesday afternoon when he heard his friend screaming from the living room.

Two men, armed with a handgun and a crowbar, had forced their way inside Burnett's north Grand Prairie apartment, he said. The intruders held Burnett and his female friend inside the bathroom at gunpoint while they ransacked the apartment for valuables, he said.

The robbers did not know that Burnett also had a gun.

"I could not believe what was going on," said Burnett, 38, who lives at the Fairways apartment complex on north Texas 360. "I tried to crack the door open. That's when they said, 'Touch the door again, and I'll shoot you.' "

I understand the copyright issues and I will abide by them in the future. However, putting a 24 hour time limit on stories in order to consider them "news" for this forum seems to me to be too stringent. I understand not digging up stories that are 2-3 years old, but 24 hours seems unreasonable, especially since some people (such as myself) don't have jobs that allow us to sit in front of a computer all day searching for stories. I have time today 'cause it's my day off.

How about a time limit of one week...or even three days? That seems more reasonable.

I drive an armored truck 12-14 hours a day. Have not driven a truck yet that has a computer in it. Only time I can really get on here is the weekends or a little in the evening if I'm not to tired.

But the truth is the self proclaim masters of GITN don't really want to see self defense links here since one of them has proclaimed twice that anybody that shoots someone in a legitimate self defense scenario an asshole unless they belong to the military or police.

"WINSTON-SALEM, N.C. -- Winston-Salem police made an arrest in the city's 14th homicide of the year.
The homicide happened around 2 a.m. Friday on Forest Hills Drive. Police said Frederick Williams shot his girlfriend Linda Nicholson and 72-year-old Melvin Wilson Pinkney.
Nicholson is in stable condition at Baptist Hospital. Pinkney died at the scene, according to officials."

"WORCESTER, Mass. -- Police in Worcester are looking for suspects following a drive-by shooting that left a man dead Thursday night.
It happened just before midnight on Main Street, right in front of City Hall.
Police say Hector Rivera, 22, of Worcester was found slumped over the wheel of his car with a gunshot wound in his left temple. He was taken to a local hospital where he died several hours later."
