GUNS IN THE NEWS--July 28, 2004
As CO Liberal sez:
Please try to adhere to the following voluntary guidelines, in order that we can have an orderly discussion of gun-related news topics:
1 - Feel free to add any CURRENT stories to this thread by replying to this message. In order to be considered current, stories should have been originally posted on the Internet within the previous 24 hours, or provide follow-up to a story that was previously posted on the J/PS board. EXCEPTION: On Mondays (since many people do not log in to DU over the weekend), stories can be posted from Saturday, Sunday, or Monday.
2 - Both pro-gun and anti-gun stories, editorials, and press releases are welcome in this thread, as long as they're current. Please do not post links to items from a few years back that support your position.
3 - Bear in mind that any links to extremely right-wing sites (such as Newsmax, CNS, or the Washington Times) or intentionally pro-gun or pro-control sites (such as the NRA or the Brady Campaign) are not considered reliable sources by many DU-ers. If at all possible, try to find a link for your story from a more mainstream source, such as a general-circulation newspaper or magazine site. If you choose to use a slanted site, be prepared for any negative feedback you may receive.
4 - Please try whenever possible to provide links to web sites that do not require you to subscribe to the site to read the story. If a subscription site is the only source you can find for a story, please note that fact in your message so people can decide whether they want to follow the link to read the entire story.
5 - Do not change story titles. In other words, if the Oskosh Gazette's web site runs a story titled "Two Killed in Holdup", the title of your message should read "Two Killed in Holdup". Don't change it to "Gun Owner Kills Two People", or anything else that changes the meaning of the story.
6 - If it's not clear from the title where the story occurred, add the city, state, or country in parentheses after the title.
7 - The person adding a news story to the "GITN" thread is allowed (and encouraged) to comment on that story, indicating their position on the topic being discussed. These comments can appear either at the beginning or end of the post; if possible, place comments in a different typeface so readers can separate the comments from the story. Others who wish to comment on a posted story can do so by replying to that story; this allows other readers to follow the comments by scrolling through the subthread.

Geeze, neurotics with concealed weapons...what could ever go wrong?

"McAdoo, an ophthalmologist who practices in Athens, has pled innocent to a charge of aggravated menacing, stemming from an incident July 9 on Shafer Street. According to police, McAdoo cut off Athens resident James Kirkendall in traffic near the West Union intersection, prompting Kirkendall to approach McAdoo's vehicle to upbraid him.
McAdoo has reportedly admitted pulling a gun on Kirkendall, but claims he did so only after Kirkendall assaulted him. Kirkendall has been charged with menacing -- a lesser charge than the one McAdoo is facing -- but he denies assaulting McAdoo."

"If Kirkendall threatened bodily harm to McAdoo, this could support a menacing charge against Kirkendall, and might also provided McAdoo with legal justification for pulling his gun, if he truly believed he was in danger of death or serious physical harm."

The Missouri Court of Appeals threw out St. Louis' five-year old lawsuit that tried to sue gun makers for the social costs of gun violence.

In their six-page opinion, Judges Gary Gaertner, Mary Rhodes Russell and Sherri Sullivan concluded that the Missouri General Assembly prohibited the type of suit that St. Louis had filed in a new law it passed last year.

The city had sought millions in compensatory and punitive damages from gun manufacturers, dealers and distributors on the grounds that the defendants didn't do enough to prevent guns from getting into the hands of those who used the weapons to commit crimes.

Filed in 1999, the suit was dismissed Oct. 15 by St. Louis County Circuit Judge Emmett M. O'Brien on different grounds. O'Brien ruled that such complaints against gun makers could open courthouse doors to limitless suits against a vast array of industries.

Neighbor Videotapes Boy Playing With Gun

Couple Released On Bond


A couple in Virginia has been charged with felony child endangerment after a neighbor videotaped their 3-year-old son playing with one of their guns.

The video showed the boy playing with a pistol. Neighbors said his parents were target practicing nearby while drinking alcohol. The parents said the gun was not loaded and the boy was in no danger.

Neighbors disagreed; they said the video tape is disturbing. Others questioned why the neighbor did not put down the camera and take the gun from the boy.

"Former Democratic presidential candidate Howard Dean told a liberal audience on Tuesday that southern voters will grow tired of the Republican's perennial appeal on social issues relating to "guns, God and gays."
"Sooner or later, voters in places like that (the south) are going to grow tired of voting on guns, God and gays and start voting on education, healthcare and jobs," Dean told the crowd of activists gathered at a "Take Back America" event on Tuesday afternoon. The event, sponsored by the Campaign for America's Future, was billed by co-director Roger Hickey as "an alternative Democratic convention."
"If you are a white Southerner, you've been voting Republican for all these years -- you have nobody to turn to. don't care about you, they (white Southerners) have nobody to turn to, their job opportunities have gotten worse, not better," Dean said, referring to a conversation he had with former Congressional Black Caucus chairman Donald Payne (D-N.J.).
Dean noted that South Carolina has 105,000 children without health insurance: "Why in the world would South Carolina vote for another Republican? I have no idea," he said."

The gun lobby is already planning its next salvo across lawmakers' bow even though the General Assembly will not be returning to Springfield until November.

Sen. Peter Roskam, R-Wheaton, wants to expand state police background checks at gun shows, but the measure requires state police to erase the information within 24 hours if the firearm purchaser comes up clean.

"My interest is to set the table for the next session," Roskam said, adding Senate Bill 3389 probably won't be discussed until spring. "It's a matter of getting something on the table and getting it started."

Regulating gun show sales has been a constant sticking point in the annual debate over gun control. The proposal also takes steps to dismantle the agency's database that tracks gun sales and removes the waiting period for firearms bought at gun shows.

Police were deployed Tuesday to strategic positions after a woman brandished a gun outside a 98-cent discount store.

The woman opened fire, and shot two people.

The incident occurred at a discount store in south Los Angeles, at 111th and Vermont.

The suspect was a woman brandishing a gun.

CLINTON --
A Clinton man shot and killed his estranged wife yesterday while their 19-year-old daughter was at their Oak Street home, then apparently turned the gun on himself, police said.

Earl E. Gonyea Jr., 43, shot Kimberly St. Hillaire, 38, in the head and chest around 1:30 a.m. before shooting himself in the head, Clinton Police Chief Mark R. Laverdure said. Their daughter, Gabrielle St. Hillaire, who was in the house with a 17-year-old friend, called police after the shooting, Laverdure said.

Gonyea was separated from his wife and not living there prior to the shooting. The couple was planning to divorce and sell the house, a neighbor said.

"It was a shocker," said the neighbor, who asked not to be identified.

"A Sugar Land man originally thought to have died in a car wreck over the weekend was found to have been shot to death while driving, Harris County sheriff's detectives said today.
Richard Garza Sepulveda, 44, was driving in the 6200 block of Sierra Blanca when he went off the road around 9:15 p.m. Saturday and crashed through a wrought-iron fence before striking a van parked in the SBC lot.
Detectives later learned Sepulveda had been at a nearby convenience store, the Mity Mart, in the 6200 block of Texas 6 South, when he became involved in a dispute with another man. One witness said Sepulveda tried to drive away, but the other man jumped on the side of Sepulveda's brown 1983 Mercedes and shot him through the window. Sepulveda drove a short distance before crashing. "

BATTLE MOUNTAIN (AP) —
The deaths of a recently divorced Battle Mountain couple apparently resulted from a murder-suicide, investigators said Tuesday.

Cody Fagg, 28, apparently killed Haylee Fagg, 27, then turned the gun on himself, Lander County Undersheriff Jack Davis said.

A deputy found their bodies Thursday night about 150 feet off state Highway 305. They had two young children.

Mrs. Fagg, an Ely native, was a dispatcher for the Lander County Sheriff’s Office and there had been previous reports of domestic violence, Davis told KWNA radio in Winnemucca.

Soldiers die in apparent murder-suicide

THE ASSOCIATED PRESS

KILLEEN, Texas --
Two Fort Hood soldiers, husband and wife, were found dead in what appeared to be a murder-suicide, authorities said Saturday.

Authorities found Sgt. Erin E. Edwards' body on the front porch of her home early Thursday. She had been shot in the head, Capt. Jackie Dunn said.

The body of Edwards' estranged husband, Sgt. William M. Edwards, was discovered in a parking lot across the street. Police said he suffered what appeared to be a self-inflicted wound.

The soldiers, both 24, had served with the 4th Infantry Division in Iraq before returning to Fort Hood in recent months.

"A Clinton man who Tuesday was said to be Jackson’s latest homicide victim actually died late Monday after he accidentally shot himself in the leg, then ran off the road in his pickup, police said today.
According to an autopsy conducted Tuesday night, Charles M. Creel, 33, of 109-B Midway Drive was not shot multiple times as earlier reported by Clinton and Jackson police investigators, said Clinton Police Chief Don Byington.
Reports originally stated that Creel, a longtime Clintonian, was wounded during an argument Monday night, leaving Clinton and Jackson police to piece together what and where the shooting occurred."

"Two men were found with multiple gunshot wounds this morning in Zellwood in a shooting still being investigated by the Orange County Sheriff's Office.
Deputies said a man who was seen staggering on U.S. Highway 441 near Jones Avenue flagged down a passerby who then took him to the nearby Fire Station 20.
Deputy Barbara Miller, a sheriff's spokeswoman, said the man told authorities there was another victim in a parked van at the intersection of Washington Street and Jones Avenue.
Both men, whose identities were not released, were taken to area hospitals after they were found at about 10 a.m., Miller said."

"Police are investigating a shooting early yesterday in Rainier Valley.
A 24-year-old man, carrying a large knife, staggered toward an arriving police officer saying the suspect "shot me, he killed me," police spokesman Sean Whitcomb said.
Police were called to the 2400 block of South Graham Street about 2 a.m. after someone reported hearing shots.
Witnesses told police the victim was in a fight with the suspect at a nearby apartment. Officers did not find the suspect."

"According to police reports, Indianapolis Police received a call about shots fired shortly before 1 a.m. When an officer arrived, he found the body of William Kelly, 9800 block of Strathmore Drive, in the 3100 block of Guilford Avenue.
Kelly had been shot in the head and was lying in the street.
Kelly was the third person killed by gunfire in two days.
On Tuesday, two persons were found shot to death, a 53-year-old Northside man and a 22-year-old Northeastside man."

"A suspect in an East Duffy Street shooting yesterday is now behind bars. Forty-one-year-old Jeffery Johnson got into an argument with another man yesterday afternoon, and investigators say Johnson pulled a gun and shot the other man at least once.
Ambulance crews rushed him to the hospital, but no one's releasing his name or condition."

Another law-abiding responsible gun owner of the sort no-one has to worry about ...

"A police shooting leaves one man behind bars. It happened at the El Rancho Mobile Home Park in Chesterfield off Midlothian Turnpike. Sources say a man got into an argument with an imaginary person, pulled out a gun and started shooting.
It was about 10pm when police were called to El Rancho Mobile Home Park. They say the man who lives inside one of the trailers was having an argument with someone who does not exist. They say he fired several shots inside the mobile home and when he came outside, the man allegedly pointed his gun at a Chesterfield officer, who then fired at him, but missed. The man was quickly taken into custody."

27. Shootings at restaurant leave 1 dead, 1 hurt (PA)

Remember, we had enthusiasts the other day trying to pretend guns in restaurants were just ducky....

"One man was killed and a second badly wounded early yesterday when an argument erupted between two customers in a Chinese restaurant in Germantown, police said.
Aaron Blackman, 35, of the 200 block of East Hector Street in Conshohocken, was pronounced dead at 3:45 a.m. at Temple University Hospital. Police said Blackman suffered gunshot wounds to the face and chest.
Quenzell Cothran, 25, listed at the same address as Blackman, was admitted to Albert Einstein Medical Center in critical but stable condition. Cothran was shot in the stomach, police said.
At some point, the unidentified man pulled a black handgun and shot Cothran, police said. Blackman, who was outside, was shot by the same gunman when he went inside to help Cothran. No one else in the business was hurt."

In one shooting, two windows were damaged at the Immaculate Heart of Mary Church, 1905 Portage Trail, he said. A house and vehicle in the 4000 block of Northampton Road were hit July 21, causing $1,300 in damage, according to police reports."

30. Had a similar incident here
They shot out 237 window in one weekend.
Found out a local that owned a glass company ,payed a bunch of kids to do it.

31. Man gets 18 months on gun charges (IA)
"An Iowa City man will serve prison time for gun charges, the United States Attorney's Office said Tuesday.
Beau Jo Boorman, 23, was sentenced to 18 months. He was charged Jan. 15 and pled guilty in May, said Al Overbaugh, spokesman for the U.S. Attorney's Office in Des Moines.
Boorman was charged with possession of a firearm as a drug user. He was also ordered to serve a two-year term of supervised release following his prison term and fined.
A search warrant was executed Sept. 5 on Boorman's residence, which he shared with co-defendant Matthew Wood of North Liberty. Officers seized four firearms, including a semi-automatic rifle and marijuana."
