Another anti-gun lawsuit is rejected by the courts
Missouri appeals court rejects St. Louis city's lawsuit against gunmakers

By JIM SUHR
ASSOCIATED PRESS

ST. LOUIS, July 27 — An appeals court refused Tuesday to reinstate the city's lawsuit against gunmakers, distributors and related trade groups over the social costs of gun violence.

The three-judge Missouri Court of Appeals panel said a newly revised Missouri law bars such legal action, and upheld the dismissal of the city's 1999 lawsuit. In that ruling last October, Judge Emmett O'Brien said such lawsuits would open ''a floodgate to additional litigation.''
St. Louis Mayor Francis Slay said he wasn't sure what the city's next move would be. ''We knew it was an uphill battle, but given the devastation of gun violence we thought it was a battle worth fighting,'' he said.

Lawrence Greenwald, who represented gunmaker Beretta USA Corp., countered ''the fundamental issue which cuts through this entire case is: Should the city, which is not a person who got shot, collect from gunmakers, who didn't do the shooting?''

1. More scumminess from the gun lobby....
A law rammed through by the GOP last year to head off an ongoing lawsuit...

Good thing that disgraceful bill in the Senate was shot down by Democratic leadership.

4. No, the GOP shut down the lawsuit AFTER it was in the courts
with that disgraceful bill....

Don't you READ the stories you post?

3. Were they just looking for money or something else?
It seems a bit slimy to go after them just for money. There are other ways to fill the coffers, but if they had legitimate manufacturing defect issues then I can see it.

6. Like what?
What other issues could the companies be responsible for beyond putting out a reliable product and adhering to the law?

7. They're responsible for the distribution, marketing and sale
to name a few issues...

Hence the desperate rush by the gun lobby and the GOP to protect this scummy industry's practices by shielding them from the liability other businesses face.

8. Those are not crimes
Just like other businesses and their products, distribution, marketing, and sales of guns isnt illegal. How can you sue them for it.

9. Sez you...the courts and the law say different
hence disgraceful bills like the one pushed through for the scum of the earth....

"Last year, a bipartisan group of Missouri lawmakers overrode the veto of Democratic Gov. Bob Holden to enact legislation barring pending and future lawsuits by governments against the gun industry over the social costs of gun violence. The legislation was meant to stop the St. Louis case. "

Thats the pot calling the kettle black.

I said the distribution, marketing, and sales of guns isnt illegal. You said the courts and law say different. Were you being dishonest or can you provide ANY proof of your statement?

18. Thoroughly dishonest in every way...that's the RKBA cause...
And yeah....why not look at the history of the St. Louis case...or the Chicago case (where the GOP has tried several times to have a bill like this shortcircuit the case)...or the Gary case....or the NYC case....

20. So you admint your dishonesty?
The question was, and is, do you have evidence to support your claim that the courts have ruled the marketing, distribution and sales of guns is illegal.

Any idiot can point to lawsuits, it takes integrity to back up your claims. Ive noticed you dont do that too often, any reason why?

15. Our RKBA crowd is too haughty to participate in GITN
Holy Koresh forbid that "noble principle" like this scummy bill be sullied with details of the actual cost to society of letting the gun industry run wild...

26. I don't speak for all pro-RKBA folks, but I find GITN a little on...
...the pathetic side. True, the stories are sad, but just focusing so much energy on one particular cause of death pushes all others off the radar screen.

27. Good point.
A more accurate title of the thread would be "Articles reporting gun deaths". Most of the post there are simply news clippings of people killed or injured by guns. Sad, but not really news any more.
