We know who they will will say "won."

1. I really don't think they will insert themselves again.
They took such a hit for their partisan actions in 2000. And they did state in their opinion that this was to be a one time only decision.

But, what do I know! :shrug:

As guaranteed as their retirements are, the Bush economy is making the American dollar worthless.

You really think they can get Sandra Day O'Connor again? Her legacy has been utterly trashed. What about the non-entity Kennedy?

Remember that fiscal conservatives have abandoned George. Only misinformed fundies and active fascists are supporting him. And McCain.

It also depends on the Congressional vote. If DeLay is defeated, his lame duck whip hand won't be much good, and the Dems might prefer to throw the choice to Congress than the Supremes. Also, many Congressmen might enjoy a chance to pay Tom back.

3. I'm not sure about that
O'Connor and Renquist wanted to retire but I believe that after they got the measure of Shrub (that he really would appoint Scalia clones) they decided to wait in hopes a Democrat (moderate they hoped) would win in '04.

4. I have thought and worried about this
and I am not so certain that if it did come to them again they would go the way of Bush* again. Not only do they not want to make that decision again we must remember that there were 2 judges who were supposedly waiting for a conservative president so they could retire. They have not retired. Could they have seen what would happen if Bush* gets to appoint their replacements? I don't know the answer but it seems possible that they also have seen the error of their decision.
