H.Res. 258 - Rule Providing for Consideration of the Supplemental Conference Report.

The Rules Committee has recommended a rule that waives all points of order against the conference report and provides that the conference report shall be considered as read. The Rule also authorizes the Chairman of the Judiciary Committee to file a supplemental report to accompany H.R. 748 - the Child Interstate Abortion Notification Act.

Conference Report on H.R. 1268 - Emergency Supplemental Wartime Appropriations Act (Rep. Lewis {CA} - Appropriations) (Subject to a Rule). The conference report provides $82 billion in emergency FY2005 funds for military operations in Iraq and Afghanistan, tsunami relief efforts, foreign assistance programs and domestic homeland security priorities. The total includes $75.9 billion for defense related expenditures: $37.1 billion for military operations and maintenance spending, $17.4 billion for Military personnel, and $17.3 billion for new weapons procurement. This bill also includes: $656 million in direct assistance for tsunami disaster relief and $222 million to reimburse the U.S. military for expenses incurred in providing emergency relief to tsunami victims; $1.7 billion for Afghanistan reconstruction and counter-terrorism assistance; $680 million for peacekeeping programs; $200 million in economic assistance for the Palestinian Territories ($50 million of these funds for assistance for Israel to improve the efficiency and security of the flow of goods and people from the Territories into Israel) with a requirement of a GAO audit on USAID's programs in the Territories, a requirement of a report on the Palestinian Authority's political, economic and security reforms, and $5 million for an independent audit of the Palestinian Authority finances; $734 million for additional State Department operating costs; $592 million for a new embassy compound in Baghdad; and $635 million for increased border security and enforcement ($450 million in new funding and $185 million offset by corresponding rescissions).

The conference report also: increases the military death gratuity from $12,000 to $100,000 and subsidized life insurance benefits from $250,000 to $400,000 for families of soldiers who died or were killed on active duty beginning from October 7, 2001; includes most of the provisions of H.R. 418 (the REAL ID Act) regarding new standards for asylum, new national standards for driver's licenses, and the construction of border fences; and includes provisions to increase the number of H-2B visas for temporary seasonal workers.

Audits find flaws in U.S. handling of Iraq deals

WASHINGTON (Reuters) - The United States has carelessly, and possibly fraudulently, handled some Iraqi money meant for rebuilding and poorly managed billions of dollars of U.S.-funded contracts, said U.S. audits released on Wednesday. In one area of Iraq alone, nearly $100 million in cash used for rebuilding was unaccounted for. Incompetence by U.S. procurement staff ranged from contractors being paid twice to files being misplaced.

Two audits by the U.S. Special Inspector General for Iraq Reconstruction found flaws in how U.S. government and military officials ran contracts paid for by the Development Fund for Iraq, Iraqi money entrusted to the United States after the 2003 invasion. A third audit looked at a small sample of U.S.-funded projects paid for with $18.4 billion appropriated by Congress to rebuild Iraq and found sloppy and disorganized administration of some of those deals. "There was no assurance that fraud, waste and abuse did not occur," all three audits said.

The most scathing criticism was in audits of the development fund, made up of proceeds from Iraqi oil sales, frozen assets from foreign governments and surplus from the U.N. Oil for Food program. Handling of that fund has already come under fire by previous U.S.- and U.N.-mandated audits. An audit released by the Iraq reconstruction inspector in January concluded the U.S. had not properly safeguarded about $8.8 billion of Iraq's own money in the development fund. Of concern in the new audits was poor oversight of hundreds of millions of dollars of cash used to pay contractors. One audit looking at about $119.9 million in DFI cash paid out in south-central Iraq, the account manager could not properly account for over $96.6 million in cash.

FRAUD SUSPECTED

"During this audit we found indications of potential fraud and referred these matters to the Assistant Inspector General for Investigations (for reconstruction)," the report said. Examples of sloppiness included 645 transfers of more than $23 million in cash using the wrong form; one contractor being paid twice for the same work, and 10 payments amounting to $324,500 were submitted for canceled contracts. Two payment officers with cash account balances of $777,050 and $715,000 left Iraq without clearing their balances with the account manager. An attempt was made to remove the outstanding balances by "simply washing accounts," the report said.

Democratic Sen. Russ Feingold of Wisconsin criticized the "disorganized, sloppy management" of Iraq rebuilding deals. more.....

REAL ID Act of 2005 - Title I: Amendments to Federal Laws to Protect Against Terrorist Entry - (Sec. 101) Amends Immigration and Nationality Act (INA) provisions concerning asylum to: (1) authorize the Secretary of Homeland Security, in addition to the Attorney General, to grant asylum (retroactive to March 1, 2003); (2) require asylum applicants to prove that race, religion, nationality, membership in a particular social group, or political opinion was or will be (if removed) the central reason for their persecution; and (3) provide that an applicant's testimony may be sufficient to sustain this burden of proof only if the trier of fact determines that it is credible, persuasive, and fact-specific. Requires corroborating evidence where requested by the trier of fact unless the applicant does not have the evidence and cannot reasonably obtain it without departing the United States. States that the inability to obtain corroborating evidence does not excuse the applicant from meeting his or her burden of proof.
Title II: Improved Security for Driver's Licenses and Personal Identification Cards - (Sec. 202) Prohibits Federal agencies from accepting State issued driver's licenses or identification cards unless such documents are determined by the Secretary to meet minimum security requirements, including the incorporation of specified data, a common machine-readable technology, and certain anti-fraud security features.
Title III: Border Infrastructure and Technology Integration - (Sec. 301) Directs the Under Secretary of Homeland Security for Border and Transportation Security to study the technology, equipment, and personnel needed to address security vulnerabilities within the United States for each Customs and Border Protection field office that has responsibility for U.S. borders with Canada and Mexico.
