HUNT: Bob, why would Senator Frist refuse an offer to break the deadlock?

NOVAK: Because the whole system (INAUDIBLE) you're not going to have -- like going to a concentration camp and picking out which people go to the death chamber. You're not going to let the Democrats do that, say, We're going to -- we're going to confirm this person, we're not going to confirm the other person. They're going to -- they're going to say that this is not the way we're going to do it. They've had all kinds of different offers of that kind.

Now, as a matter of fact, I believe that this -- this constitutional option is going to work. I think it's going to -- they're going to get the 50 votes that are needed....

2. Apparently "constitutional option" is the new catchphrase
rather than "nuclear option". If this is just a matter of changing the names around dems should change the name to "unholy option" or "666 option" or "satan's option". Of course this would give into the Bush frame. <sigh>

please bang a baseball bat into my head or SOMETHING? These people are sick sick sick! The filibuster is a 200 plus year old tradition in this country. Each party has used the filibuster sometime in our history. He's taking away our history and democracy and comparing this to the Nazi's because they don't get their way? Asshole!

So, are you saying that the Republicans came up with Nuclear Option, then accused the Dems of creating the phrase and now they want to change the name to Constitution Option? Didn't anyone listed to the debate so far.....Byrd said it well and a lot of others as well.

My problem with this is that these people always get angry when Democrats compare Bush or his actions to Hitler and the Nazis, but they are always willing to compare Democrats and their ideas or thing they support to Hitler and the Nazis. The Democrats should make a big deal out of this.

If a German minority had had a filibuster those camps might have never existed.

Frist says it won't affect filibusters of legislation? What about all that rubber-stamp legislation that amounts to little more than White House appointments/directives? Why continued filibusters of that?

Hmm. The primary "justification" for the Nuclear Option is that filibusters of judicial nominations is unconstitutional because the Constitution requires that the Senate give an up or down vote to the President's judicial nominees.

It does? Let's look at the document. Article II, Section 2 says:

" shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments."

So, the President's power to appoint judges comes from exactly the same clause in the Constitution from which he derives his power to appoint cabinet secretaries and other executive branch officials. So, if the filibuster is unconstitutional for judges, isn't it also unconstitutional for other appointments?

Frist doesn't seem to think so. He insists that, while the Constitution doesn't actually contain any language requiring that judges get an up or down vote, the "advice and consent" language should be interpreted to mean that Senators must actually vote on each nominee.

Not only does this completely contradict history, tradition and common sense, it is a rather bizarre case of reading into the Constitution something that's just not there.

Isn't that exactly what Frist and his ilk are blasting the Courts for doing? How often have we heard them bellowing about the Supreme Court finding a right to privacy in the Constitution when the document contains no such language? Yet, here they are finding all kinds of rights and obligations in the Constitution where none exist at all.

What a bunch of hypocrites!

They only need it for judges right now. If that works out okay maybe later they'll get around to doing it for legislation and executive appointments. And then? Sky's the limit! The Republican Enabling Act of 2006?
