John Roberts Sided with Operation Rescue, Convicted ...
Edited on Thu Aug-04-05 06:48 PM by madeline_con
Clinic Bomber, and Anti-Choice Extremists
Summary:

In Bray v. Alexandria Women’s Health Clinic, Supreme Court nominee John Roberts, then Principal Deputy Solicitor General, co-authored and submitted for the United States an amicus curiae brief, siding with the notorious anti-choice group Operation Rescue and some of the world’s most aggressive and violent anti-choice extremists, Michael Bray, Randall Terry, Patrick Mahoney, and others. In the amicus brief and during oral argument, John Roberts maintained that Operation Rescue’s unlawful behavior and “military-style tactics” used to block women from accessing reproductive-health clinics did not amount to discrimination against women and that a civil rights remedy was inappropriate.

********************************************

In 1990, John Roberts, then Deputy Solicitor General for the first President Bush, filed an amicus or "friend of the court" brief in Bray v. Alexandria Women's Health Clinic on behalf of the United States in support of convicted clinic bomber Michel Bray, the notorious Operation Rescue, and five other individuals who routinely used "military-style tactics" and other forms of intimidation to block access to reproductive health care clinics.

Now you can get an inside look at the type of people Roberts actively defended by watching HBO's excellent documentary about Bray and his organization "Soldiers in the Army of God: America Undercover." Originally released in 2001, "Soldiers in the Army of God" provides a horrifying inside look at the extremist faction of the anti-choice movement that seeks to end abortion through terrorism and murder.

1. This is weird
because I just got done reading in my paper about Roberts working on cases FOR gay rights.

This guy is a mystery to me....

I can' tell where the Hell he is at on any issue.

But that's enough for me not to trust him and not to want him on the Supreme Court.

3. As solicitor general
was he operating according to his own opinions, or those of the administration for whom he was working? I don't know, I'm asking. How much does one's own judgement feed into such a position?

And, was he siding with Operation Rescue, or just saying that the case wouldn't work civilly. You don't have to be for or against something to say they don't have a case. And making a civil case based on discrimiation against women sounds like it might have been to far a stretch to prosecute these guys. You can't always get a perp on the charge you want. Don't forget they got Capone on tax evasion, though he'd done much worse.

Dunno. Just trying to think like a lawyer.

2. Planned Parenthood Site
Yes, this case was described on the Planned Parenthood site. The Supremes have also decided to hear the case of Arroyo v NH Parental Notification Law (no emergency exception for life of mother). This is supposed to be heard sometime in the Fall, just in time for the "hurry up, up or down vote" on Roberts.
