Constitutional flaw RE: no impeachment of administrations & an amendmment |
|
Edited on Mon Oct-03-05 10:50 AM by expatriot
I have always thought that one glaring obvious flaw in our Constitution is that there is no way to impeach and remove an entire administration. Since the V.P. would just move up to President and then he could name his own V.P and the cycle would just go on and on.
How about an Amendment that reads something like this....
Following the impeachment and removal of the President, the Vice President shall serve as acting President. If this Acting President, being the Vice President of the original administration, is likewise impeached and removed then both Houses of Congress shall within a week of the Acting President's impeachment and removal agree to a date no less than 150 days and no more than 180 days in which an emergency general eleciton shall be held for the Office of President. Political parties wishing to take part in said emergency general election are hereby directed to devise a primary candidate selection process in which their party's candidate will be nominated by the party no less than 75 days before the date of the emergency general election.

1. the more direct way would be to provide for a "no confidence" vote |
|
which would require, say, 2/3rds of both houses to call for a new general election, at which point the public could re-elect or vote in someone new from any party, although, in practice, the in-party would most likely nominate a new ticket given the sound rejection by congress.
there are advantages but also disadvantages to such a system. personally, i think simply fixing our vote-counting process would solve address much of these concerns, as shrub would have had zero years as president if only we could count properly.

2. Problem.. Every president would be impeached |
|
if the opposition party is in power. We'd have constant special elections. Clinton's impeachment proved that any president can be impeached with no justification or reason.
The theory is good, but the details are a bit sketchy.
