NC vs. Diebold update

Diebold filed a suit last week on the basis that it could not disclose Microsoft's code to the state and it would be prosecuted if it didn't.

A judge threw out Diebold's request to be shielded from criminal prosecution if it refuses to disclose software that is owned by Microsoft Corp. or other third parties.

Trouble is, this seems to be a lie. An examination of the Windows CE license program reveals that the vendor MAY reveal the source code. In fact it EXPLICITLY states:

Governments may read and reference the source code but may not modify it.

Perhaps some lawyers out there can tell me what happens to a company that files a lawsuit over a false issue?

speaking for MS, here...this is a very serious issue and the code Diebold is using is old source code...like ANCIENT. They certainly would not agree to withholding it, especially where its unsecure use is a voting machine!
