5. That is what the cloture vote is. It tests whether a filibuster will hold.
It is how you filibuster. 47 votes in a final vote is final. Filibuster is a prolonging of debate. This does just that.

6. The best bet would be having the house move to the senate's version
but the IQ of the entire House of Representatives barely reaches 4 figures, so it is unlikely that they will use reason or logic.

Chances are the Patriot is dead? 50-50. If after x-mas they don't reconvene, then it is dead.

Kindof like they did with the Federal Reserve Act.

They're like that, you know. Repubs primarily, i mean.

"Our financial system is a false one and a huge burden on the people . . . This Act establishes the most gigantic trust on earth."
-- Congressman Charles Augustus Lindbergh, Sr.

...The Congressmen prepared to leave Washington for the annual Christmas recess, assured that the Conference bill would not be brought up until the following year. Now the money creators prepared and executed the most brilliant stroke of their plan. In a single day, they ironed out all forty of the disputed passages in the bill and quickly brought it to a vote. On Monday, December 22, 1913, the bill was passed by the House 282-60 and the Senate 43-23...

:woohoo:

from cnn:

http://www.cnn.com/2005/POLITICS/12/16/senate.patriot.ap/index.html

WASHINGTON (AP) -- The Senate on Friday rejected attempts to reauthorize several provisions of the USA Patriot Act as infringing too much on Americans' privacy and liberty, dealing a huge defeat to the Bush administration and Republican leaders.

In a crucial vote early Friday, the bill's Senate supporters were not able to get the 60 votes needed to overcome a threatened filibuster by Sens. Russ Feingold, D-Wisconsin, and Larry Craig, R-Idaho, and their allies. The final vote was 52-47.

President Bush, Attorney General Alberto Gonzales and Republicans congressional leaders had lobbied fiercely to make most of the expiring Patriot Act provisions permanent, and add new safeguards and expiration dates to the two most controversial parts: roving wiretaps and secret warrants for books, records and other items from businesses, hospitals and organizations such as libraries.

Feingold, Craig and other critics said that wasn't enough, and have called for the law to be extended in its present form so they can continue to try and add more civil liberties safeguards. But Bush, Senate Majority Leader Bill Frist and House Speaker Dennis Hastert have said they won't accept a short-term extension of the law.

..snip

The Patriot Act is set to expire Dec. 31.

Some of us do want this anti-civil rights Act to expire. Some of us appreciate the Bill of Rights. Some of us are unwilling to give up our hard-won rights out of fear and paranoia.

39. As republican's talked about
"God help us" and we let this expire and there is another attack...there were just two parts of it they showed we needed. One was for the CIA and FBI (and whoever else) to exchange information. I don't remember the other one.

But fair enough, write a bill that allows those two things. Not the whole act.

The House version that they'll now vote on had all sorts of add ons. I couldn't find them all in one place yet. But one was expansion of federal death penalty to include about 40 new offenses...and to keep getting new juries to determine sentencing if the first jury rejected death penalty. And to need fewer votes to get the death penalty.

That alone would need a lot of debate (or immediate rejection)

During the House debate I heard mention of other troubling ones such as protecting vaccine makers from lawsuit (past and future) and increased monitoring of peace protesters. But I didn't find those when I searched yet.

38. Lisa Murkowski is getting a LOT of praise from the media in Anchorage...
She's a moderate (pro-choice) Republican.. but since being appointed by her daddy to the U.S. Senate, she started to vote straight down the party line on everything..

Just over a week ago, she was a guest on a local progressive radio station and callers were telling her how much they miss the way she used to challenge members of her own party on issues (before she went to the U.S. Senate). They reminded her that Alaska may vote for R-presidents (because of oil drilling), but that she shouldn't forget that the majority of residents are Independents.

Who knows?!? Maybe she took their advice? Hopefully this won't be the last time she votes with Democrats! This is the first time since she became a U.S. Senator when I can actually say THANK YOU LISA! :o :o :o

41. Excellent news! I absolutely love it when our reps stand up and fight
for our rights! It is a beautiful thing to behold. The Murtha fight over the Iraq war--for all its Republican-caused confusion--was also amazing. Democrats jumping out of their seats and protesting lies and misrule. Wow! I've couldn't have lived 60 years through two horrendous and illegal wars, and the current junta, without developing considerable skepticim (if not outright mind-boggled disbelief) about what our politicians say and do, but I can also be moved to tears by just plain old democracy in action. It's been a long time coming.
