Alito “Fails the Test.”
Senator Leahy began Alito's final day of testimony by making clear what was at stake:
"This will be the last opportunity for the American people to learn whether
is going to serve to protect their liberty, their privacy from government intrusion. The Supreme Court's our ultimate guardian. I'm still troubled by some of the questions."
At the day's end, Senator Leahy suggested that Alito had "failed the test." Senate Minority Leader Harry Reid was similarly chilly to Alito's nomination. "I have not forgotten that Judge Alito was only nominated after the radical right wing of the President's party forced Harriet Miers to withdraw. The right wing insisted that Justice O'Connor be replaced with a sure vote for their extreme agenda. Four days of hearings have shown that Judge Alito is no Sandra Day O'Connor."
Does Alito understand his impact on ordinary Americans?
Senator Durbin made a final push to get answers from Alito on whether he understands the “crushing hand of fate.” Durbin asked why Alito concluded that IRS agents went “too far” when they patted down a veterinarian and his wife and detained them for several hours, yet argued to uphold the strip search of a mother and her 10-year-old daughter without a valid warrant. “Did it go into your thinking this whole question of the dignity of the individual; that we are, in fact, dealing with a mother and a 10-year-old daughter who were subjected to the most intrusive search?” Durbin asked, suggesting that Alito doesn’t understand the effect his rulings have on ordinary Americans.
