A man's life is at stake. His name is Vito Valenti. On Sept. 11 he was caught in the maelstrom and stayed at Ground Zero as a volunteer to help in the frantic rescue and recovery operation. And today he is dying.

He is 42 years old.

He cannot work.

He has no pension.

He has no health insurance.

He has no money for medications.



His lungs are being destroyed by pulmonary fibrosis.

His only hope is a double lung transplant, but he cannot afford even the oxygen he needs to make it day by suffocating day.

Only through the good graces of a generous medical supply company is he being sustained with the fundamental requirement of life: breath.

"After hearing that he was a 9/11 volunteer, we decided to donate the oxygen," said Ed Brown, sales representative for Homecare Concepts in Farmingdale, L.I.

Someone in power must help Vito Valenti, for he will die without it.

Numerous officials have responded to this series of editorials by pledging to aid the forgotten victims of 9/11. Today, they can be of critical service.

Mayor Bloomberg, Gov. Pataki and every elected and health official who let the 9/11 epidemic expand unaddressed ought to knock this morning on Valenti's door. Inside the upstairs apartment of a two-family house at 1320 A St. in Elmont, L.I., they would meet a man who personifies how seriously ill some Ground Zero responders are. And they would see, in the most extreme way, that many are being denied proper assistance.

Like thousands of others, Valenti is at the mercy of a workers' compensation system that is ill-suited, if not hostile, to reimbursing them for lost wages and picking up health care costs. New York's compensation law was written to cover standard accidents, such as falling off a ladder, and illnesses directly related to a specific occupation, such as repetitive stress nerve damage among meat cutters. The law was not designed for illnesses that emerge over time from the inhalation of unprecedented amounts of toxins by 40,000 workers with disparate jobs.

As a result, Valenti is among a vast legion who are barred from filing claims because they realize they are sick more than two years after 9/11, the time limit for starting a case. His only hope rests in legislation that would extend the filing period for9/11 responders. Such a bill is on Pataki's desk. So Valenti lives on $1,430 a month in Social Security and cannot afford drugs to treat his illness and prepare him for a transplant.

"He is dying," said Dr. Maria Padilla, medical director of Mount Sinai Medical Center's lung transplantation program, who began seeing Valenti in April 2005. "Unless he can get coverage for his medications and get ready for a transplant, there is no hope."

Valenti is a divorced father of two. He lives with his 74-year-old father, who is battling heart problems and cancer, and he lost his mother to cancer in February. For more than a decade, Valenti worked as a lunch aide in a Queens middle school and then became a grievance representative for his union, Local 372, with half his $60,000 salary paid by the union and half by the school system.

Valenti's office was at 125 Barclay St., directly behind the World Trade Center, making him witness to the full horrors of 9/11 and positioning him to serve as a volunteer. Over the next two days, in the thick of a toxic cloud, he distributed water and supplies and remembers escorting a dazed and bleeding firefighter to a triage nurse. He slept on West St. with a roll of paper towels as his pillow.

"The smell of death was everywhere," Valenti said. "It was like hell."

The nightmare took a toll. Diagnosed with posttraumatic stress disorder, Valenti went on paid leave for six months and unpaid leave for four. Because he filed on time for PTSD, workers' comp reimbursed the Education Department for his sick pay.

By February 2002, Valenti was also coughing. Over the coming months, his respiratory distress worsened, leading eventually to a diagnosis of pulmonary fibrosis in March 2004. Fibrosis is a scarring of the lungs that prevents the body from oxygenating the blood. It is a form of interstitial lung disease, the illness that took the lives of Firefighter Stephen Johnson, Police Officer James Godbee, Detective James Zadroga and telephone worker Mark DeBiase.

Valenti exhausted his health benefits in December 2005, making it impossible for him to afford more than a dozen medications. The company that provided his oxygen supply took its equipment back.

Lacking his medications, Valenti gave up on the lung transplant program. Two weeks ago, he was admitted to Winthrop-University Hospital in Mineola in the throes of a respiratory failure. Doctors stabilized him, gave him a 30-day supply of medicine, and a nurse secured free oxygen for him from Homecare Concepts.

Many city workers who were disabled after responding to 9/11 are eligible for special three-quarter-pay pensions under legislation enacted in 2005. The law says their illnesses are presumed to have been caused by the event. But here, too, Valenti is out in the cold.

First, he had declined to join the city retirement system before9/11, a decision that may make him ineligible for the special pension. Second, he would need to prove that he served at Ground Zero for 40 hours. His only witness, union Vice President Santos Crespo, said he believes Valenti served for the required time. But Crespo lost track of Valenti in the chaos and so can't swear to it.

State Sen. Michael Balboni's office is trying to figure out whether Valenti is entitled to a disability pension. The law is unclear, leaving Valenti to wait for the end of a long, bureaucratic process, when he has no time to wait. The life expectancy of people with his disease may be as little as three years. Much of that time is already gone.

"I'm begging for someone to help me," Valenti said. "I do not want to die."

He shouldn't have to beg.

3. Always remember: Bush sanitized EPA report on air quality
at WTC. A little warning would have gone a long way. But the idiot son wanted the financial markets to stay open. I'm sure those now sick and dying are just "collateral damage".

A country where only those with the means to pay for medical care will be "entitled" to it. That's why we MUST have universal healthcare. But as long as we have the current system wherein HMO and insurance and pharma company lobbyists can buy legislation, we are all fucked.

6. Mad Compassion
That's what we need some mad citizens. Keep it focused and try to keep your compassion. We need to gain fundamental rights such as life. Don’t think just because you are working for the government your butt is covered. No safety net there.

“Many states still do not have Occupational Health and Safety Programs for employees and employers in the public sector, state, local, municipal governments and educational systems. In fact only 26 states have some sort of system in place.”

About 6,000 workers die every year not to mention the ones left with no quality of life.

where money decides who lives and dies just look at Katrina.We had a small window of opportunity following Katrina to level the playing field alittle but we let it pass.It's an uphill battle and we are against tons of money.

15. Sadly, this poor man is one of thousands dying for lack of
health insurance. How many times have you seen a car wash or bake sale or other event held for the purpose of raising funds for medical care? This is America and we shouldn't have to beg for health care.

This is truly a barbaric country, b/c we don't have universal healthcare. It's not like one can choose not to get sick. We have a socialized police force, socialized military, socialized fire protection, socialized road repair, all paid for out of our tax dollars; there's no reason we can't join the civilized countries & have universal healthcare.

I saw her speak about this topic at the Take BAck America conference and I believe the concern in her voice over this issue was genuine and she was passionately trying to help the heroes of 9/11 who had been abandoned by their government.

I'm going to forward it even though I'm not one of her constituents.

I also forwarded it to Oprah's show - whether or not you like her, you have to admit that she's got a huge audience that would be responsive to this sort of situation (I actually suggested a show on the volunteers and rescue workers in general and their circumstances now).

1. he needs to apply for permanent disability, like yesterday
2. spend down any assets so he can get on Medicaid
3. see if he can get Medicare coverage expedited

This is the only way to survive with an incurable chronic illness in today's America. Hubby had to go this route: he had ESRD, and then discovered he had kidney cancer. The state of California picked up the tab for his surgery, and he is now on dialysis, with Medicare and Medi-Cal coverage. Yes, you have to give up any ideas of a future, but it does mean getting necessary medical care and medicines NOW, when you need it.

On Monday, August 28th, Senate Bill 840, authored by State Senator Sheila Kuehl (D-23), passed out of the California State Assembly on a preliminary vote of 43-30 (final vote expected to be 44-31).



SB 840 provides a concrete plan for covering every California resident with comprehensive health insurance, saves the state of California, businesses and working families nearly $8 billion in the first year, and guarantees our right to choose our own doctor. The bill will now return to the State Senate for concurrence and is expected to reach the Governor’s desk by September 1st.



SB 840 provides comprehensive medical, dental, vision, hospitalization and prescription drug coverage to every California resident. This broad coverage is made possible through a streamlined claims and reimbursement system that is projected to save billions of dollars in administrative costs. SB 840 allows California to use its purchasing power to negotiate bulk rates for prescription drugs and durable medical equipment, such as wheelchairs, thus realizing an additional $2 billion in savings, SB 840 preserves the status of healthcare providers, hospitals and pharmacies as private, competitive businesses.



The plan is funded by drawing in current public spending and replacing all premiums, co-pays and deductibles paid to insurance companies with premiums paid to the system. As amended, the bill creates a blue ribbon panel of health, finance and technical experts to lay out the mechanics for an affordable premium structure using information gathered in available funding studies.



"The growing cost of health insurance is bankrupting our businesses and working families. Our health care system is being decimated to pay for insurance company waste", says State Senator Kuehl. "SB 840 is the right solution for California’s broken health care system. It covers everyone, it contains costs and it improves quality – most important, it guarantees your right to choose your own doctor."



"This plan provides security and savings to every California family, helps businesses by reducing their health insurance costs, and saves the state almost a billion dollars", said Speaker Fabian Nunez. "The Governor should sign this historic bill."



"Right now we have a broken system that leaves too many Californians in medical or financial jeopardy and a system that hinders economic growth", said President Pro Tem Senator Don Perata. "SB 840 is responsible, it’s achievable and it’s what we need to do to fix the health care system in California."



I realize this gentleman in the original post is not from/in California, but ideas like this are spreading. I'm hoping that State Senator Sheila Kuehl, whose bill this is, will be able to inspire her counterparts in other states, with the momentum and just plain "oomph" this should give her. NOBODY should have to beg for this kind of help, especially a 9/11 Good Samaritan!

I read through a couple of the cases and couldn't believe what i saw and i see this kind of stuff every day. I had no clue that companies could disregard a judge without any repercussions. They are doing some great work on that end.

I'm republishing this article by New York Committee for Occupational Safety and Health (NYCOSH) Communications director Jonathan Bennett to make sure it gets wide distribution. If you know anyone who might be affected, please pass it on or reprint it.

In short, New York State has just passed a law making tens of thousands of people, including volunteers, eligible for workers’ compensation. The law went into effect on August 14 and those who are eligible have one year to register.

NYCOSH is a non-profit educational advocacy organization that has been active in fighting for medical treatment for workers and volunteers who have become sick as a result of exposure to toxic substances in the aftermath of the collapse of the World Trade Center. They are concerned that many of those eligible will not register because they are unaware of the new legislation that extends the time limits for filing claims.
