Cuyahoga BOE will arrest Lovegren for seeking to tabulate vote count
November 6th, 2006

Victoria Lovegren may be Arrested on criminal charges for seeking to see precinct-level election results in Cuyahoga County!

Cuyahoga County is filing criminal charges against me because I asked some volunteers for the Vote Count Protection Project to call some of the Election Day Technicians, and ask them if they would be willing to write down some of the Voting Unit election results on a data-collection form, to used for vote-count verification purposes.

We were doing this because Blackwell's directive on 11/1 said that we could not add any more "Observers" to the list of observers, so we could not get "inside access."

We were doing this because Cuyahoga County was NOT going to post results for the public to see.

We were doing this because of Cuyahoga Board of Elections' dismal record of the May Election debacle, secrecy and law-breaking,, and, in general, 92% of the public distrusts electronic voting!

We were doing this because the proposed post-election "audit" being paid for by the Cuyahoga County Board of Elections is a total SHAM! The
audit will NOT be counting actual ballots, but sub-totals of ballot counts, and will not be counting all precincts, but a subset of the precincts. Their proposed "audit" is nothing of the sort!

The people want to "see" the precinct-level election results, and the CCBOE is refusing to let us see them. From the calling that volunteers made yesterday, we learned that Election Day Technicians were told, during training, that they could NOT read aloud the totals on the Summary Totals report, they, in fact, could not even LOOK at the totals on the report, and, obviously could not let anyone ELSE look at them.

The CCBOE is continues to operate in secrecy, and are now trying to intimidate anyone who seeks transparency in the election process. They are making an example of me because I am getting too close. How dare we ask to see precinct-level results?

They told me that I could get council and then report to a hearing tomorrow at 1:30pm-election day. They have nothing better to do, on election day, than to stop this dangerous middle-aged woman!

If you would like to support me tomorrow as they throw the book at me-they said I was being charged with criminal "obstruction of business", ORC 2921.31-please come to the Cuyahoga Board of Elections at 1:30pm.

Dr. Lovegren has been notified that she may face criminal charges for attempting to document the precinct-based vote totals tomorrow. Lovegren runs "Ohio Vigilance" ( http://www.ohiovigilance.org )

In "Hacking Democracy" you see Dr. Herbert Thompson implanting a trojan horse into the GEMS central tabulator, altering the election results. He might have been caught, the film says, by comparing the poll tapes -- the results at the polling place -- with GEMS. In Cuyahoga County, though, local officials have refused to post the polling place results, thereby neutralizing the only check and balance that would have caught Dr. Thompson's simple hack.

In fact, it is not even clear if the system remains NASED/EAC certified, if the polling place results aren't posted. Because of very serious vulnerabilities including a controversial (many say illegal) interpreted code called AccuBasic, the EAC says that these voting machine results tapes must be used, and are a critical defense.

But Cuyahoga doesn't want voters to see them. Instead, they want to quietly bring them into headquarters, without posting them.

2. Let me get this right. The polling places will NOT be putting up the lists
of people who have voted as they have done in the past?

Typically, GOTV efforts rely on those lists to call people.

Do I have this right?

3. Correct, no summary or interim postings
Ohio Public Radio this morning reported that it is no longer a "procedure" in Ohio to post voting results at each precinct. The activists lost a lawsuit to try to fix this. (I am just recounting what I heard while I was doing the dishes. I don't have all the details.)

And you are so correct. That tool has been taken away from us. Intuitively, this just does not "seem" right. It has always been a civic tradition that we could go down to the voting place on Wednesday and see what was tabulated.

Voting results will now just be carried to the Board of Elections in data cartridges, tapes, notes, etc. in "somebody's car" and we are to trust the results. Gasp.

5. Here are some of the early problems reported in Cuyahoga county
Poll Watch: Pohlman Blogs Any Potential Election Problems

8:47 a.m.

Techicians are checking 43 polling locations that are using paper ballots.


8:38 a.m.

Alcazar Hotel and Grace Christian Missionary Alliance are voting by paper ballots. There are 43 poling locations that have some sort of problem, like partially voting paper or the text not showing up on the machines.


7:45 a.m.

How quickly things change. Beachland Presbyterian up and running voting with paper at Highland Heights Community Center. Robert Fulton Elementary turning people away. They are checking into. At Woodbury School in Shaker, there are lines out the door. Two machines are working.


7:30 a.m.

Everything running smoothly still using paper ballots at Boulevard School.


7:08 a.m.

At Boulevard School, one machine working but paper ballots are being used. Also, the election day technician had not shown up so a replacement is on the way. All polling locations are open.

6:56 a.m.

Some polling locations have not called in yet. About four polls had purple status but that was resolved within minutes. As I am writing this I am hearing about a problem at Boulevard School in Shaker Heights paper ballots are being brought out because machines are not working.

6:35 a.m.

Polling location at wiley middle school in university heights nobody there to open polls yet

6 a.m. So far so good. Polling locations are starting to call in to say they are on line and ready to go.

6. Well I truly hope the Democrats have somne activist judges around somewhere
Ohio seems to have become quite UnAmerican these last few years have't they? They don't want anyone to see the vote tallies just take their word for how it turns out....:shrug: I predict they will get away with it and no one will hold them accountable. It is how America has become in the last decade...

7. I would like to see Strickland's first official act as Gov
be ot prosecute Whitewell and everyone in his SoS office who attempted to keep people from exercising their RIGHT to vote. Those people need to be made an example of. A few 5-year stretches in real prsion will say to the enemies of democracy, "The price for screwing with the Constitution has just gone up".

Get the democrats to back you and get legal support.
