The prosecutor brought a number of charges. One was thrown out.
He doesn't want to have two trials. If he tries on the charges that still stand and *then* an appellate court reinstates the charge that's been thrown out, then there will be two trials. So while the prosecutor is appealing the one rulling, he has the trial on hold.
Blame the prosecutor.

They have one now ready to be passed that will allow all but one of the charges to be dropped. They want the conditions for the last one dropped but it would also let two many other felons skirt the law.
