The 11th Circuit Court of Appeals has dismissed a federal lawsuit against the Democratic National Committee over the party's decision to strip Florida of its delegates to the national convention.

Florida voter Victor DiMaio filed suit in 2007 and accused the DNC of violating the 14th Amendment to the U.S. Constitution, specifically the Equal Protection Clause. DiMaio claimed that the DNC violated his constitutional rights when it punished Florida's Democrats for moving its primary to an earlier than allowed date.

10. It will probably be appealed to the Supreme Court, but I don't know if they will review it

The Circuit Court of Appeals is pretty damn high up there. The only place left to appeal is the US Supreme Court. I don't know whether or not the Supreme Court will review it though.

6. Well it turns out
they didn't really rule on his suit. They denied him standing because the suit was filed before he voted.

All he has to do is make some minor changes to the suit and refile it.

Hillary Rodham Clinton will be able to keep her distance as this tool hands the decision over who will be the Democratic Nominee to Scalia, Thomas, Roberts and Company.

Wonder how that will turn out?

Pardon me, while I go puke. Bush v. Gore came with a disclaimer saying that it could not be cited in other cases. Well, hide and watch as "Equal Protection" once again applies to making sure that certain votes get counted while others don't.

Can you imagine any scenario that would help McCain and the GOP more than awarding the nomination to HRC?

Someone needs to talk to this fellow.

"The Democratic National Committee said it was pleased with the decision.

"As two U.S. District Courts in Florida have found, and as the Supreme Court has consistently recognized, national political parties have a constitutionally protected right to manage and conduct their own internal affairs, including the enforcement of delegate selection rules," it said in a statement.

DiMaio told The Associated Press he was encouraged by the ruling and would amend his lawsuit and return to court.

"This is a big victory," said DiMaio, who said he is neutral in the presidential race. "As close as this election can be, these little votes can make a big difference in who could be the next president of the United States. That's why I'm anxious and ready to go. And the clock is really ticking."

Florida and Michigan have had so far fruitless discussions about possibly redoing their primaries. Any redo would have to be completed by June 10 to be counted under Democratic National Committee rules."

He is wasting time and money while McCain is free to prepare for the GE.
