"A Florida court threw out a lawsuit Wednesday challenging the Democratic Party's decision not to seat delegates from Florida — as litigants prepared to appeal the case to the U.S. Supreme Court.

Political consultant Victor DiMaio and his lawyer Michael Steinberg had compared the party's decision to earlier prohibitions against allowing African-Americans to vote and invoked the trauma of the Florida recount in the 2000 contest between Al Gore and George W. Bush, both arguments also used by Hillary Clinton to support the seating of the state’s delegates

Democratic Party chairman Howard Dean says the situations are not comparable.

"You cannot violate the rules of the process and then expect to get forgiven for it," he said.
Judge Richard Lazzara sided with the party, saying that this was not a civil rights issue, the parties have the right to make their own rules.

This is the second such suit that has been brought in FL, Sen. Bill Nelson and Rep. Alcee Hastings brougth suit earlier, which was also thrown out, on the same grounds.

1. What a stupid waste of time and money for goodness sake.
Haven't we got enough crap going on in the world without having to have this garbage taking up valuable time? I'm sure that our courts (judges, lawyers, staff, etc.) must have other things to do then deal with this nonsense. Shame on all everyone who thought it necessary to bring these suits to court.

4. I hear they are considering appealing to the Supreme Court
One problem with that is, the Supreme Court's term begins in October. The court, I believe, has already stopped hearing new arguments for this term and will soon recess so there is no way for it to be heard until the next term. Would they honestly want to try and drag this case on AFTER the convention has already been held?

6. I agree, but...
The idea that it was even litigated to begin with has scary shades of 2000. I have been hearing rumblings about this for a few weeks. It makes me nervous.

They hear the case in October, Obama wins the election in November and sworn in the following January, only to learn that the SC has ruled in Hillary's favor?

9. My question exactly
Someone with more legal expertise than I would have to answer this, but I would guess that the fact that time will have passed for a "just remedy" to be granted would be grounds in and of itself to refuse to hear the case.

Citing the previous time that the SC interfered in the electoral process.

Why Not?
She claims she can hold a Primary Election anytime she wants without sanction from the Democratic Party or the DNC.


Meanwhile,
Obama will still have WON the Democratic Nomination according to all legitimate elections and sanctioning rules,
AND,
Obama will still be president.
Banging on pots and pans will NOT change that.

14. I was about to ask about the one pending.
Taking it to the Supreme Court is ridiculous, as is most of this that has gone on. But, they won't be hearing any new arguments until October, right?

I don't see Hillary having the support, money or even gall to take it PAST the Convention.

Honestly, I don't see how she can take it TO the Convention.

17. I think they hear until August, the SC that is.
In one of my posts about DiMaio, I wrote that he said they hope to be heard before they adjourned in late August.

I'm no expert, so going by what he said.

Hillary should be preparing her supporters for the end of the campaign next week, instead of
partaking in these completely asinine theatrics.

Instead of being a true leader and helping her supporters to move on from a race that is about
to end--she's yelling fire in a crowded voting booth!

She is orchestrating mayhem and a real mess--and whipping her supporters into a lather--as
she convinces them that they are all victims.

What a complete disgrace.

This is a spectacle and a real embarrassment to our party and also to women.

I've never seen anything like it.

It was truly a pity party on the news. If I hear the word disenfranchised one more time from this bunch I will scream.
