7. A dilemma: Rapists would be more inclined to murder if the penalty is the same. |
|
While both crimes deserve the most severe punishment imaginable, it is not logical in practice.
Since a murdered, raped child is less likely to identify the rapist, the rapist may be inclined to murder the child should the consequences be the same.
As a mother explained on a radio program, "I can talk to and sooth my abused. I cannot talk to or sooth my murdered child."

29. that is a good point. |

Another reason why I'm ambivalent about the whole issue.
And the consequences of false witness or confusion during a trial - it must be beyond a shadow of doubt.

8. I am in favour of the same penalty I am for ALL rapists--that they be tried, convicted, |
|
imprisoned, and turned over to the biggest, the meanest, the roughest person in there, to be that person's sex slave. maybe THEN they will have some small comprehension of the nature of their crime.

10. The reality is that a lot of those rapists already had that experience |
|
as children. It's called the circle of abuse. This doesn't mean that they shouldn't be imprisoned for life, with NO possibility of parole. However, the vast majority know first hand about physical and sexual abuse from brutal adults.

11. I voted against all executions, but.... |
|
What I don't understand is why those who do favor the death penalty don't support changing the sentencing criteria for all capital punishment. To me it is a no brainer to do everything humanly possible to NEVER execute an innocent person. If someone wants to argue in favor of the death penalty at the very least why not agree to reserve it for those situations where it is INCONCEIVABLE that the person being punished is not guilty of the crime that they are accused of. None of this "guilty beyond a reasonable doubt" nonsense when somebody is having their life taken by the State. Air tight 100% certainty of "guilty as charged" evidence should be a minimal threshold for imposing the death penalty. In other words, if it is not absolutely impossible that someone could be innocent, how on earth can any one justify taking that person's life?

12. For it in two circumstances... |
|
1. The guy (and let's face it, it's almost always a male) has been convicted of this before and done it again, because at that point his 'rehabilitation' can be seen as a failure and it's likely he'd do it again if he ever got out; and 2. The child dies as a result, which would be felony murder in those states which have the death penalty anyway, so I guess that's a wash.
Basically, if you do this, you're as sick as it gets, but even these pigs deserve one chance to right themselves. If they do it again, it simply means that they're not wired right and should have their ticket to the planet revoked, as they've then become serial child rapists. Nothing ruins a life (other than straight-out murder, of course) more than a child who's raped. I just heard a story on the radio (sorry, no link) about a woman in Seattle who went to the home of a sex offender who had just moved into her neighborhood. He had just been released from prison after being convicted of molesting two five-year-olds. The woman went to the door with an aluminum bat and opened a can of ass-whoop on him (he was over 7-feet tall) with said bat. To be really honest, I would have a hard time convicting her if I was on that jury, even though she obviously committed the offense charged.

28. I would tentatively add another circumstance... |
|
...that he'd done it repeatedly and over a long period of time to multiple victims, without getting caught or revealed as a sex offender. The father who abuses all of his children; the uncle who abuses more than one child in the family. The boyfriend who abuses children habitually with every child of his women friends. Dare I add the priest who moves from parish to parish and has a list of victims going back decades. Random incidences are horrific enough; planned methodical habitual rape of children deserves another level of hell as punishment, and the sooner they get there, the better.
However... as an alternative, somebody mentioned leaving them in the general population in prison, without protection, and it would serve the same purpose. I'm not opposed to that either. In fact... that's even better.

27. I feel the same way. I'm against the death penalty.... |
|
but.... not that strongly that I would feel bad if a murderer or child rapist was put to death. In my opinion, a person that can do that to a child is a violent, sick individual. If they have that in them... what don't they have in them?

23. Tattoo "Child Rapist" on their forehead and give them life in prison in the general population |
|
I would also transfer them every 5 years to a new prison so they could make new friends, keep their social calendar full.
Death by lethal injection is to good for them.

|
Edited on Thu Jun-26-08 09:27 PM by TOJ
A main problem with the death penalty is that mistakes are made. within the last few weeks a convicted rapist was exonerated after 20 years in prison. Let that sink in for a minute. then think about executing him. when George Ryan suspended the DP in Illinois, half of the people sentenced to death in that state were actually innocent. Half!
I frankly would rather just lock them up and throw away the key. It prevents the ultimate mistake.
