Florida lawsuit against DNC refiled on August 14.
One lawsuit by a Florida state senator, Steve Geller, was just dropped. He dropped it because Barack Obama agreed to seat the delegates from Florida with a full vote. More on the case is here.

But the case against the DNC by Victor DiMaio of Tampa has been refiled, reinstated for the umpteenth time. I lost track. It was reinstated on August 14, according to this to this website

I wrote a lot about this case because the person who filed it and his lawyer actually were amused when they talked to the media about its basis. It was that ridiculous to them.

But it was reinstated.

Suing DNC for discriminating against white people in FL, using Rule 11 to get to the Supreme Court

South Carolina and Nevada were allowed to hold their primaries before February 5th because the high percentage of blacks and Hispanics in those states helped compensate for the pasty complexion of Iowa and New Hampshire.

That's the basis for an amended legal filing planned by Tampa Democratic activist, Victor Dimaio and attorney Michael Steinberg who are suing to have Florida's entire Democratic delegation seated at the National Convention in Denver this summer. DiMaio's original lawsuit claimed the DNC's punishment of Florida violated the equal protection clause of the 14th amendment, but that suit was kicked back by the federal appeals court in Atlanta. Steinberg had a brainstorm when he read discovery papers in a similar lawsuit filed by Senator Bill Nelson that showed the DNC put South Carolina and Nevada's primary dates ahead of 46 other states to give minorities more of a voice in the nominating process. Since the DNC receives federal money to hold their convention, the party is subject to federal civil rights law.

What an interesting turn of the worm. Sometime next week, we may have democrats suing democrats for carrying out a very democratic policy of advancing minorities. Steinberg and DiMaio acknowledge with a grin that their reverse racism accusation will ruffle feathers, but hope the conservative judiciary will be delighted to strike a blow against affirmative action and rule in their favor. Their only objective, they claim, is to see all of Florida's delegates seated based on the January 31st primary election.


Yes, they actually grinned.

They say they do not plan on stopping.

The Civil Rights Act of 1964 states that no federally funded organization can discriminate based on race. What Steinberg and DiMaio discovered was that Democratic primaries in Nevada and South Carolina were allowed to occur before the window of other primaries because of their racial demographics.

If they lose the appeal, Steinberg has a backup plan to use Rule 11, which would take the case out of circuit courts and move immediately up to the Supreme Court.


So, it is not over here in Florida. In so many ways.

2. florida has some of the dumbest people in the news - this is over
we have a candidate - this clinton thing is ridiculous and I wonder how many reagan dems/repubs are part of this - race is definitely an issue in this race whether stated or not - and then you just have dumb voters and so many reside in florida

this is not aim at you madfloridian
this is a republican ploy in several states to upset the apple cart - many did not go vote since their vote was not going to count

4. We retire Marco Rubio from running around with more of his *100 ideas*.
5. We say NO to privatization of our government and elections.
6. We get new Florida Democratic leadership.
7. We take back control of our White House; our gutted justice system; our destroyed intelligence agencies; our nonexistent foreign policy; our broken military; our shattered economy; our predatory financial systems and our hemorrhaging deficits/debt.

8. We repudiate for all time the malignancy of the nearly 30 years of voracious destruction by conservative ideologues, ruthlessly engineered by Reagan, George HW Bush, George W. Bush, and the Bush family, including deceased Prescott, now with Jeb, Neil and Marvin, which have driven this country and the people of many other nations in the world into socioeconomic, political and moral catastrophe.



The people of this country are rising up.

5. Trouble is, seafan, there is no outrage even at DU over this suit.
It is just another thing to :shrug: at and say oh well.

No one seems especially concerned at all.

6. I think this is aimed at removing Howard Dean as Chair.
Obama has said recently that he wants to seat all FL's delegates at the convention. That, in itself, should render this lawsuit moot. Apparently, it hasn't. So that leads me to believe that there is another agenda operating. This is no longer about candidate Clinton.

The primary reason that I see for these people to press forward with this suit is to undermine Dean's leadership. And we know the group who would like nothing better than to do that.


Dean's leadership is also a thorn in the side of Ms. Wasserman Schultz in her quest for *rising star* status in the Party.

As long as Chairman Dean presides over the party, it is a lingering reminder of Wasserman Schultz's behavior over the past year, and frankly, it gets in the way for her.



I think people are just overwhelmed by everything that's swirling around us, madfloridian.

Just keep digging, exposing and reporting. It's the way we will advance.

7. I tend to agree.
Florida Democratic leadership is still not on board with Dean as chairman. He crossed them and followed the rules.

I just feel sick over all the people locally we are alienated from now.

wasserman schultz and gellar among so many have exposed themselves for what they really were
the anger at these people is running pretty deep over here on the east coast and im in nelsons home town
his approval here is now 0
if a decent candidate runs against nelson
in a primary
nelson i think would lose
so we have the threat of his self interested actions possibly putting a republican in his seat in the senate

8. the leader for the dem party in florida had a questionaire online asking
if they should pursue this - that was months and months ago - I for one and others said no not to waste money on a new primary or anything else - her letter stated the republicans are the ones who set the date knowing it was against the rules and called it number (the number of votes that al gore won by) -

right now we are eating our own when the time, money and energy needs to be on getting the republics out of office - they control the florida government - I can vote democratic but there are a huge number of right wingers here and from what I can see a number of them are seniors - notice the flags in front of their houses in retirement communities.

so when I say it is over - this primary is done - the rules were broken - the people you need to fight are the other voters who vote for this mess

they voted for the 50,000 exemption so now the state and cities are upping the property taxes to compensate - seniors don't realize they think they are doing something for themselves and it just screws everyone - so now there is less for education and parks but they will still pay the same taxes because the cities and counties will get their money one way or another -

I am outraged that so many people have american flags out and vote republican - I had an person fix the air conditioner and asked if I was left and then stated if he were in iraq his gun would always be warm - did not understand or care to understand that iraq did not attack us - just believes we need to control the region and it is a good war - fix that attitude - put your time, money and energy into fixing these people's attitudes

What court would accept a lawsuit saying the DNC discriminated against white people?

21. your statements sounded like you thought the lawsuits and the primary
was right - no where did I pick up that you thought this was nuts for the democrats or that you believed Dean did the right thing by sticking to his guns about the rules and following them - the lawsuits and the dems in florida seem to be against democratic party everywhere but my experience in my short time here amongst seniors is they are crazy and they have their flags everywhere and they are vets etc. They don't seem to get this whole admin doesn't like people and could care less for seniors or anyone else -

repubs want the dems to eat their own and have the repubs doing it all the time - they are nuts -

perhaps stating your initial posting more clearly that you are AGAINST what they are doing and why might get people to understand your outrage -

between the florida repubs and my family repubs - I see the same traits of bullying and intimidation and not owning their own sh *** t and instead accuse everyone else of doing what they are - whether that be gay or bigoted - I mean look at strom thurmond and his black daughter - the news media did less with that than they do with edwards or spitzer or anyone who is a dem - they don't do anything against repubs -

I was thinking for the governor of NY who is a repub but registered as a dem to run - the florida dems seem to be like that - and the repubs I have meet are like Elizabeth on the View - no brains - no thought processing - they are all brainwashed - I do not have a solution - I can not talk to them anymore - my anger is just so at the surface - I have to walk away

when I have to stand in line to go through checkins at the airport - I know I can not stand it anymore - so I drive - I fear cops and people in authority who are part of enforcing crazy rules - they are dangerous - and it is getting worse in my opinion -

so something stupid like the lawsuit and seating clintons' delegates should be nipped in the bud by clinton - and she has not done that which makes me feel her early repub nature is what is really there - she switched to dem when it suited her.

sorry for all the clinton lovers out there but I don't need four years focused on clintons parts in the oval office - I need some kind of sanity in this crazy police state (country) we are living in

What if a judge declares in favor of Dimaio, that the primary rules were not fair, even though everyone voted for them.

Does no one care that courts are now involved in our party process?

Could this negate the primary?

and recently in rulings
held that political party's are private endeavours whose rules are made and enforced by the members themselves

several of these jackass suits have led to actual rulings that basically say this
