While we can't prove he did hear/see/read the questions before hand, neither can he prove he didn't. So that is a draw.
Next, he definitely had opportunity and motive.
Then you go to all the weird jumping the gun that McCain did.
I'd say he is in a worse place than we are. We win on points.
