Legally speaking, there's no reason why Obama couldn't name Bill Clinton VP |

17. becomes is not elected...but it still can't happen. |
|
The requirements to be the vp are the same as the president and the amendment is clear and straightforward: No man shall be elected president twice.

5. That's debated and debatable. |
|
The Vice President has to be eligible to be president, which sounds like it excludes Bill, since a president can't be elected to more than two terms. However, the exact wording is that the VP has to be eligible "to be" president, and no president can be "elected" to more than two terms.
So, there is room for debate, if someone wants to try it. :)

First, the 22nd Amendment, setting term limits.
"1. No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once."
Now, the 12th Amendment, setting VP requirements:
"But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States."
See the loophole? Clinton isn't ineligible to be president, only to be elected president. One could argue that either way. "Ineligible to the office" could mean ineligible to be elected to the office, or it could mean ineligible to hold the presidency. Clinton meets all the requirements to be president--35, natural born citizen, etc. But he can't be elected.
Might make a fun SCOTUS case, if anyone wanted to test it. Obama could. McCain could, for that matter. How's that for scary? :scared:
