If Drudge were a simple news organization that made a mistake, that would be one thing. But Drudge is a right-wing mouthpiece, and purposely attempted to use this unconfirmed story to alter public consciousness in disturbing ways. So yes, he should be investigated for this - you're 'fire in a crowded theater' analogy sounds about right to me.
