Berg files another lawsuit, claims Obama is an "Illegal Alien"
9/11 "truther" and PITA Philip J. Berg, a disgruntled Clinton supporter who filed a suit against Sen. Obama and the DNC trying to get Obama off the ticket, has filed a new lawsuit in US District Court for the District of Columbia.

His previous lawsuit was dismissed in Federal Court and the US Court of Appeals, and is now on Justice Souter's desk as an appeal to the US Supreme Court. That lawsuit claimed that Barack Obama could not be president due to Berg's claim that he is not a US citizen due to either birth in Kenya or adoption in Indonesia.

The current lawsuit is a fraud claim stating that Barack Obama was improperly elected senator due to his "not being a US citizen", and asks the court to remove him from office and force a return of his senatorial salary and all other monies paid him as a senator. He's using the same "evidence" he appended to the Supreme Court appeal - claims from a fundamentalist "bishop" and a supposed interview with Obama's step-grandmother in Kenya, as well as the Indonesian school record that supposely "proves" he's an Indonesian citizen.

It's case 1:08-cv-01933-RWR on the PACER system.

Expect the freepers and other scum-suckers to be jumping all over this ASAP.......

1. Can't he be declared a vexatious litigant?
Such people are forbidden from filing lawsuits due to a pattern of frivilous lawsuits.

Let him and the freepers chase their tails all they want. It keeps them busy while the rest of us try and pull the country out of the mess the Bush administration has put us in.

Sorry, I'm not a lawyer, so I don't know how these things work.

time he files without court permission.

I got sued in a huge federal lawsuit several years ago and it was the LAST case that psycho ever filed. I never even hired an attorney, just let all the other parties' attorneys whittle away at the case and get dismissed from it (40+ defendants, lol), until there was just little ol' me left, and the federal judge wrote me a letter that was, like, WHY is she suing you and WTF is going on, lol. I told my side of the story in a letter to him and that was the end of that. Dismissed with prejudice. Ruled a VL.

The woman invoved whan an attention-seeking cat rescue psycho, malignant narcissist, sociopath, whatever. Total nutball. The original suit and all her filings were hilarious reading.

42. Someone needs to file a professional conduct complaint
We scum-sucking, bottom-feeding subhumans known as lawyers are subject to a code of ethical conduct. While there are small variations in some states, the basic code promulgated by the American Bar Association is in effect in every state and DC. The enforcement process can vary wildly, though.

Someone needs to file a conduct complaint with the appropriate oversight body in Pennsylvania and any other states where Berg is licensed (check NJ, Delaware, and DC). Actions which tend to bring discredit upon the legal profession constitute grounds for discipline, which can be as lenient as a private reprimand or as severe as disbarrment.

And more importantly, how soon before he's disbarred for clogging up the system with ridiculous lawsuits?

15. To be fair, we on the Left chased a lot of blind alleys the last 8 years
I won't name them here, as I don't want to get into the weeds with another discussion/fight, but in any event, all the blind alleys led us astray for years.

It is heartening to see them making the same mistakes now too.

24. Ah, yes.....
Leo Donofrio's lawsuit. He's now accusing Supreme Court clerks of "sabotaging" his case.

Donofrio's case is a bit different from Berg's, he's claiming that having a parent that's a citizen of another country is a automatic bar to be president due to "divided loyalty", and that the 14th amendment doesn't really grant "natural born" citizenship status, just citizenship. It's a "tiered citizenship" arguement that claims someone can be born in the US and be a citizen, but not a "Natural-born" citizen

25. Well, his arguments during the primaries.....
....was that Obama drop out so "properly vetted" Sen. Clinton could become the nominee.

After the primaries, his case was originally to force the DNC to drop Sen. Obama from consideration due to citizenship questions.

Before election day, it was trying to stall or postpone the election.

Now? The focus is trying to get the electoral college to overturn the election.

Curiously enough, fellow wingnut, anti-semite Andy Martin, thinks Berg is a "Obama plant" trying to discredit the anti-Obama movement. As if they needed help.
