my sister says there will be riots over Obama's birth certificate!?!
Apparently the wingnuts still believe his birth certificate is a fraud.

She says there will be a constitutional crisis over this, and riots if a non-citizen is inaugurated.

Who is perpetuating this smear? Who is the force behind the continuing defamation of Obama?

Obama’s Birth Certificate Challenger Keeps Going

You've got to hand it to Philip J. Berg: he doesn't give up easily. You might recall that Philadelphia attorney Berg tried, and failed, to halt the presidential election of Barack Obama on the grounds that he is not a native-born citizen. Game over, right? Wrong.

Berg filed a writ of certiorari to the U.S. Supreme Court in late October, asking that the highest court review the decision of the U.S. District Court in Pennsylvania. The latter court dismissed Berg's claims because he lacked standing to bring them. Standing requires plaintiffs to prove they are directly affected by the issue at hand, with evidence of injury that is concrete and particular. In its decision the district court said Berg "does not, and we believe cannot, establish injury in fact." It also dismissed his claims as frivolous.

Berg takes this in stride. His writ, he says, requires Obama and the Democratic National Council to respond by December 1. Also, he has another arrow in his quiver. He's filed in the U.S. District Court in Washington, D.C., under the False Claims Act, which is often used in Medicaid fraud. "I am basing this on the fact that as a U.S. senator is collecting money illegally because he is not a citizen of this country," he says.

Former presidential candidate Alan Keyes joined the fight to release President-elect Barack Obama's birth certificate this week, suing to keep the California Electoral College from meeting.

The suit is the latest of many lawsuits filed requesting the birth certificate, a document that Mr. Obama has so far refused to produce in court. The lawsuit, filed by Mr. Keyes and the American Independent Party (AIP) in the California Superior Court in Sacramento, requests the court to bar the secretary of State from certifying the names of electors to Gov. Arnold Schwarzenegger, R-Calif., and from transmitting a certificate of election each presidential elector.

"I and others are concerned that this issue be properly investigated and decided before Sen. Obama takes office," said Mr. Keyes in an AIP press release. "Otherwise there will be a serious doubt as to the legitimacy of his tenure. This doubt would also affect the respect people have for the constitution as the supreme law of the land. I hope the issue can be quickly clarified so that the new president can take office under no shadow of doubt. This will be good for him and for the nation."

The Electoral College will meet in each state capital to cast its votes on Dec. 15. Dec. 1 is also an important debate in the controversy, as Mr. Obama must respond to a federal case in the U.S. Supreme Court by that date, which will be heard by Justice David Souter, a jurist with a liberal reputation.

I would love to see him put this to rest by producing the crinkly old 1961 original completed on a typewriter and signed by someone who was there.

In addition, I'm sure the hospital would have some sort of billing or surgical notes, or something from back in the day. Producing this stuff would put this matter to rest.

Having reported on local news for 12 years, I can tell you that the paper won't print it if there's no record of it.

I can't find the copy of my old crinkly one, either, but the state certifies these things. These people just won't accept reality.

All this shit just smells like a cover-up. I'm on O's side, but we were all over Palin for Trig's birth records and her medical records, and McCain for the same things. I do find the announcement in the paper to be pretty convincing, but I'm going to be a concern troll on this one.

Hawaii merely is choosing not to release the original long-form birth certificates. I'm sure if Obama requested them, he could at least get a redacted copy that would remove all doubt.

If the State of Hawaii doesn't issue long form birth certificates, they can't start making exceptions for one person, whoever he is. This isn't some banana republic where whatever the President wants, the President gets (much to W's regret).

presumably so they can be used as documentation or evidence, especially concerning the person they pertain to...

I'm just saying that our side is always calling for public access to documentation, such as W's National Guard records, and candidates' medical records. This seems to fit that model, and it would be easy enough to clear the air. Why not do it and remove all doubt?

A certified copy of a birth certificate is considered acceptable proof of citizenship by the Department of State. It was considered acceptable proof by the Pennsylvania court that kicked out the Philip Berg case. What makes you so special that you demand a higher standard of proof than they do?

If this was their guy and not our guy, this board would be full of people screaming for proof and the release of the original records and the letter from Admiral Nimitz and an investigation and hearings and OMGZ and ONOZ.

All this stuff about how a laserprint from 2007 "should be good enough" and hiding behind some bureaucratic excuse is just lame. The guy's 47 years old... he didn't bother getting a copy of his birth certificate until after 2001? Seems to me that having lived in so many places in his life, he'd have his paperwork in apple pie order.

This board went apeshit when freeps were talking about changing the constitution to allow Schwarzenegger to run for president. I guess I'm just showing the same concern for the integrity of the constitution.

The lack of skepticism around here is disquieting, as is the shouting down of anyone who questions the matter.

I've needed certified birth certificates for all sorts of stuff. In most states, you wander over to the records office, pay your ten bucks, they print it up, emboss it, and you're on your way.

I don't have a wrinkly old piece of paper from 1963, and I'm certain Barack Obama doesn't either.

...are the only ones buying this myth. And the more they get debunked, the weirder the claims get. The latest is a claim the Kenyan ambassador said on radio they would put a marker on Obama's birthplace. Yet there (as usual) doesn't seem to be any proof.

And so far, all the lawsuits are either "pending hearing" or "dismissed" Not one has made it past the hearing stage and gone to trial.

took the time to proclaim that they "believed", weeks after election day, that John Kerry would spring forward with some blockbuster hidden evidence on or before January 20th to snatch the Presidential Oath from Dubya at the last moment. Even though it never happened, certain "believers" not only still exist, they bask in a substantial following.

We've seen this kind of self-delusion before. Thanks be to God it's on THEIR side this time, rather than on OURS.

but that was grounded in a very real and IMO very valid concern over how the votes were counted in Ohio. Remember Boxer moving to not certify the results? There was definitely some "there" there two years ago.

it was the day after the big protest in late October 2002 (right after Paul Wellstone had died in that plane crash).

I had a suite and us girls were in the bedroom and the late great wonderful Khephra was out in the living room area where he slept. The next morning I woke up and Kheph & Ramsey were watching this protest laughing their asses off at the stuff that was going on. It was a wonderful memory.

He says Obama is not a real American citizen because his father was not a US citizen, ignoring the facts ahta his mother was and that he was born in the US.

There are some others who believe Obama himself was born in Kenya. Evidently some Kenyan dignitary said that there is a monument to Obama in Kenya to mark the place of his birth.
The monument is for our President Elect's father, who shares the same name, was born in Kenya and did much good for his country.
I am certain there are many other idiotic myths that are deeply held beliefs of some people who just cannot comprehend that the Republicans lost, and that a black man and a Democrat will be OUR PRESIDENT.

Berg is a disgruntled Clinton supporter who had been trying to demand Obama step out all during the primaries.

His claims on the birth certificate fakery are from right-wing and PUMA sources, (to be precise, two so-called internet "Experts", Polarik and TechDude). His claims about citizenship are almost cut and pasted from posts by neo-confederate "Judah Benjamin" on the PUMA blog "TexasDarlin.

Most of the lawsuits out there, (even Keyes lawsuit) are cookie-cutter clones of Berg's lawsuit. At least 7 of those have been dismissed to date. Berg's lawsuit has been dismissed once, the appeal was dismissed, and he's now waiting to see if Justice Souter dismisses it.

There's another lawsuit, Leo Donofrio's, who is arguing that Obama AND McCain are citizens but not "Natural Born" citizens and therefore cannot be president. Donofrio seems to believe there's multiple tiers of citizenship. Justice Thomas has recommended that it be reviewed in conference by the entire supreme court, and as a result, many freepers and PUMAs are believing that's a slam dunk in their favour.

One of the things that many of the debunkers of Obama's having been born in the US say is that the certificate Obama has supplied is a Certificate of Live Birth, not a birth certificate. For the True Believers, it is an article of faith that in Hawaii you can register a birth as much as a year after the event and still get a certificate of live birth from the state's vital statistics office. Their reasoning runs something like this:

Obama was born in Kenya (his paternal grandmother is alleged to have stated this, the Kenyan ambassador is supposed to have said that a special sign commemorates where Obama was born and there is an imam who is seeking political asylum in Great Britain who supposedly has the paperwork that proves Obama was born in Kenya and the imam had to leave Kenya because the government was out to get him) I did mention the conspiracy theories right?

Next, Obama's mother takes Barrack to Hawaii and registers his birth, which makes him eligible for the issuance of the Certificate of Live Birth. The threads on this other site frequently get shut down by the moderators because they degenerate into name-calling and flame wars.

One thread went on and on about the Berg suit and how it was going to blow the "Obama citizenship conspiracy" wide open. There was much speculation by fellow believers about who would be president, with McCain/Palin being the choice of most posters. It was spectacularly weird.

Having typed all that, I will admit that I don't understand the December 1 deadline being mentioned. I thought that cert was not granted by the Supreme Court to Berg's suit, so I fail to see why there is any need for Obama to reply to anything.

Obama was born in Kenya (his paternal grandmother is alleged to have stated this, the Kenyan ambassador is supposed to have said that a special sign commemorates where Obama was born and there is an imam who is seeking political asylum in Great Britain who supposedly has the paperwork that proves Obama was born in Kenya and the imam had to leave Kenya because the government was out to get him) I did mention the conspiracy theories right?

so they're milking it for all it's worth. Their pathetic whinings go unnoticed by virtually everyone, and one nuisance lawsuit after another gets thrown out.

There will be a SCOTUS conference on one of the suits, and they'll refuse to hear it. That won't stop the idiocy, though. It will continue through the entire eight years of Obama's Presidency.

As for the riots promised by the Freepers, they'll occur in the same place all the Freepers' activities occur...in their tiny little minds.

145. This seems to have started with a rumor that some relative of Obama's in Kenya ...
... claimed that she was present for Obama's birth ... in Kenya. They claim to have an audiotape to that effect ... but there's absolutely no proof that it's not another crazy Andy Martin/Philip J. Berg hoax.

Numerous other urban legends have sprung up since -- that he lost his citizenship in Indonesia, that he was born in Canada ... then there's incorrect reading of immigration law at the time Obama was born (there was a "years of residency" requirement for U.S. citizens giving birth overseas while married to foreign nationals (which Ann Dunham didn't meet because she was only 18 at the time of Obama's birth), but since Obama was born in Hawaii, it doesn't apply, and the Freepers are spreading the rumor that it DOES apply).

They all seem to ignore the fact that 1) the health dept. of Hawaii has stated it has Obama's birth certificate (which meanhe was born in Hawaii ... no way they'd have it if he was born overseas) and 2) the FBI, CIA, State Dept., NSA,Treas Dept. (Secret Service) -- a few of them at least -- have certainly vetted Obama (if they don't vet major-party candidates running for president (to make sure they're no threat to our country), what are we paying them for?) and obviously found him to meet all the constitutional requirements for prexy. And if the Clintons couldn't find anything that would have thrown him out of the race for prexy, then that information doesn't exist!!!

148. The point about Hawaii having his birth certificate is a good one.
If he had been born overseas, NO state would have his birth certificate on record. His birth would have been recorded at the appropriate US Consulate. One would have to request a copy of the birth certificate directly from the U.S. Department of State.

This is similar to the situation in WWII when persons of Japanese ancestry were rounded up and sent to internment camps, while people of Italian and German ancestry were left alone. If you look "different" or "foreign" or "exotic", your "American-ness" is challenged. The whole birth certificate business smacks of racism and it makes me sick. How many other presidential contenders citizenship has this clown challenged? I'll bet none. :eyes:

147. Here are some interesting bits of law that the Freepers have been bandying about
Here's who can be prexy, according to Article II of the Constitution:

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

The pertinent passage from the Naturalization Act of 1790:

The Act also establishes the United States citizenship of children of citizens, born abroad, without the need for naturalization: "The children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens".

HOWEVER ... below is the U.S. immigration law from when Obama was born in 1961 ... this paragraph applies only to those born OUTSIDE the U.S. (and since we know Obama was born IN the U.S., it's a "moo point" (as Joey from "Friends" might have put it) or a "mute point," as the freepers might say)).

If Obama HAD been born outside the U.S., with an 18-year-old American mom and a Kenyan dad ... he may have had problems. His Mom had not lived in the U.S. for at least five years after the age of 16 by the time Obama was born (see immigration law below).

But, I repeat, since Obama was born in Hawaii, it's not an issue.

U.S. Immigration law that applied from December 24, 1952 to November 13, 1986:

"If, at the time of your birth, both your parents were U.S. citizens and at least one had a prior residence in the United States, you automatically acquired U.S. citizenship with no conditions for retaining it.


"If only one parent was a U.S. citizen at the time of your birth, that parent must have resided in the United States for at least ten years, at least five of which had to be after the age of 16. There are no conditions placed on retaining this type of citizenship. If your one U.S. citizen parent is your father and you were born outside of marriage, the same rules apply if your father legally legitimated you before your 21st birthday and you were unmarried at the time. If legitimation occurred after November 14, 1986, your father must have established paternity prior to your 18th birthday, either by acknowledgment or by court order, and must have stated in writing that he would support you financially until your 18th birthday."

Wingers are also throwing into the mix the fact that Obama Sr. had a tribal marriage in Kenya before he married Ann Dunham in the U.S. ... so was their marriage binding, or not? They seem to think that has some bearing on the situtation, but I don't really get that part.

At least all this stupidity has taught me something -- that immigration law back then was hostile to U.S. citizen teenage parents married to foreign nationals and giving birth abroad!
