Prop. 8 sponsors seek to nullify 18K gay marriages


The sponsors of Proposition 8 asked the California Supreme Court on Friday to nullify the marriages of the estimated 18,000 same-sex couples who exchanged vows before voters approved the ballot initiative that outlawed gay unions.

The Yes on 8 campaign filed a brief arguing that because the new law holds that only marriages between a man and a woman are recognized or valid in California, the state can no longer recognize the existing same-sex unions.

"Proposition 8's brevity is matched by its clarity. There are no conditional clauses, exceptions, exemptions or exclusions," reads the brief co-written by Pepperdine University law school dean Kenneth Starr, the former independent counsel who investigated President Bill Clinton.

The campaign submitted the document in response to three lawsuits seeking to invalidate Proposition 8, a constitutional amendment adopted last month that overruled the court's decision in May that briefly legalized gay marriage in the nation's most populous state.

5. They are making their way through the courts.
If they overturn Prop 8, this will propbably be thrown out.

If not and they void our marriages. It's back to the battle.

We were warned that we could be in legal limbo for years.

What really pisses me off is that if and when it's legal again .... we'll probably have to get married AGAIN!

Hopefully the judges remain as un-stupid as they were when they overturned the discriminatory law in the first place.

If people who love each other and are committed to each other are not allowed to marry, that cheapens my marriage. The fact that we have friends that honestly deserve to be married more than we do, yet cannot, is a big part of why we haven't gotten married.

If marriage isn't about love, then what's the freaking point? (and yes, we understand the legal implications of marriage and of course think they should be available to all)

If Prop 8 is upheld, the value of my marriage is absolutely in jeopardy.

If loving, committed couples are not allowed to marry, then "marriage", as our legal system defines it, is no longer about love. It simply cannot be. All marriages are in danger of becoming an extension of the church's definition of "marriage"; permission to have sex and reproduce.

It's a shame that more people don't understand this and the very real threat that gay marriage bans pose to their own lives, and our secular society. This goes so much further than an individual's personal feelings about gay sex. This is much more about the religious right trying desperately to chip away at the separation of church and state, and using homophobia to do so. Unfortunately, where they have failed with abortion, they are having great success with gay marriage. But we should all remember that gay marriage is only a stepping stone for them.

Supreme Court would have to overturn it on those grounds even if it did make its way through CA courts.

Also of relevant interest, per article one, section nine, California Constitution: A bill of attainder, ex post facto law, or law impairing
the obligation of contracts may not be passed.

So it would be a violation of the California constitution as well as the US Constitution (note that marriage is a contractual obligation).
