How to easily debunk the stupid RW talking point on Sotomayor |
|
Every single stupid RWer I encounter appears to believe she was overturned 60% of the time. I'm guessing Sean or Limbaugh told them.
Sotomayor had 5 opinions reviewed by the supreme court. 3 were overturned. She has written 380.
If the Supreme Court denies Writ than the opinion is upheld. Therefore she has actually had 99.2% of her opinions upheld. Not 60% overturned.

2. The US Supreme Court overturns 75% of the cases they choose to hear. |

Sotomayor actually had SIX opinions reviewed by The USSC and 3 were overturned. That's 50%. That's 25% better than average.
Last week Limbaugh was saying it was 80%.
Now he's down to saying 60%.
But he won't admit it's a percentage of the cases the court chose to review. Limbaugh is saying it's 60% of all her cases.

Isn't good enough for the Supreme Court, then who the hell is?
If the reich-wing lizarbrains really can't see anything beyond their white-male resentment complexes, then that's even more of a reason why we need affirmative action in this country.

The decisions that she drafted are those for the entire court on which she sat; the COURT made the decision, and a member of the court, sometimes Judge Sotomayor, drafted decisions for the court; sometimes, others did so. The entire court approved her drafts, some members may have suggested changes/edits.
The only decisions that were entirely hers were those made when she sat as a District Court judge, that is, a trial court judge.
