Ballot provision may disenfranchise voters

Colorado's secretary of state has drafted a rule that would allow only presidential votes to count on some provisional ballots. The courts should throw out the rule.

A citizen's ability to vote is one of the most cherished rights in our democracy, but some Coloradans could see that right limited by a rule from the secretary of state's office.

The rule, drafted by Secretary of State Donetta Davidson, says that some voters who cast provisional ballots this November will have only their votes for president counted. No other votes will be counted - not even those for statewide races and ballot issues.

Provisional ballots are relatively new to the election scene and were first used in Colorado two years ago. They are given to voters who aren't on a precinct poll list or who don't provide identification. Such ballots aren't counted until after a voter's registration has been verified, which sometimes doesn't happen until days after an election.

2. DU, Please help to make sure that all votes are counted
Colorado is a swing state and can use every vote....please take a look at www.dailykos.com for the folllowing info. Please drop an email and let them know you want all votes counted...colorado does not want to be another Florida.

From Colorado Luis: Another Republican Secretary of State is stealing votes from Democratic candidates.

In Colorado, Donetta Davidson has ordered that on a provisional ballot, the only vote counted will be the vote for president. Votes for Senate and Congress will not be counted. Given the competitive Senate race and a number of competitive House races, this could destroy the Democrats chances of winning control of the Senate and the House:


If this rule had been in effect in 2002, no provisional ballots would have been counted, and Beauprez' narrow win over Mike Feeley in CO-7 would have been more comfortable -- provisional ballots, usually cast by people who moved shortly before the election (or who forgot to bring photo ID), heavily favored the Democrat in that race.
This could hobble Democratic efforts to win a majority in Congress.

Colorado Common Cause is suing to stop Davidson's order. You can act as well:

Although Kerry won't win Oklahoma, we could pick up a Senate seat with Tom Coburn.
