Get Active: House Bill 1237. Losing your Constitutional Rights |
|
HB1237 will require all new home builders to have a disclosure statement on new home contracts DEMANDING that the homeowner agree to mandatory arbitration.
But.....the bill will not require the disclosure to state:
BOTH PARTIES UNDERSTAND THAT BY AGREEING TO THIS CONTRACT THE RIGHT TO A CIVIL TRIAL GUARANTEED BY THE 7TH AMENDMENT OF THE UNITED STATES CONSTITUTION IS WAIVED.
Arbitration in new home contracts has been proven to be a complete consumer scam. It is EXPENSIVE and grossly UNFAIR to the homebuyer.
email paul.powell@house.state.tx.us and tell him NO on HB1237.
for background read "The Abuse of Arbitration in New Home Contracts" www.hadd.com/documents/arbitration.pdf

2. Watching a show on Cspan right now about BMA |
|
Very interesting. I never thought about this before, but there are a number of instances they're discussing (farmers, car dealerships) regarding this. Clauses like these are harmful and hurtful. BMAs remove the deterrents for companies to behave themselves.
I'll try to make a vid clip of the part I heard.
