Texas seeks records of Tiller patient who died

TOPEKA - George Tiller has been subpoenaed to provide medical records as part of an investigation by Texas authorities involving a patient at his Wichita abortion clinic who later died.

Attorney General Phill Kline announced the subpoena at a news conference Tuesday. He is asking the Sedgwick County District Court to honor the subpoena from Texas, which is investigating the death of a 19-year-old disabled woman.

Tiller is not the target of the investigation, Kline said.

A statement issued by Tiller's lawyers said that Texas is seeking medical records and that other medical facilities have received similar subpoenas in this case.

So if Dr. Tiller is not the target, what is AG Greg Abbott investigating? What kind of witch hunt is our anti-choice AG doing? Why is there little news here in TX? Or is this just a political favor to an AG buddy of his in Kansas?

The clinics were not identified in the legal brief, but the attorneys who filed the request before the Kansas Supreme Court represent Tiller, whose Wichita clinic is known as a provider of late-term abortions.

Kline and Tiller are political enemies; Tiller has donated tens of thousands of dollars to defeat Kline.

But Kline said of his investigation, "This is about law enforcement." He declined to comment further about the scope of the probe.

Except for the legal brief filed by the clinic attorneys, all documents in the case have been sealed. The inquisition is before Shawnee County District Court Judge Richard Anderson.

Tiller's attorneys released a statement that said: "Kansas law presently requires medical providers to report the suspected abuse of children in a fashion that preserves the privacy of the patient. Dr. Tiller knows those laws and scrupulously follows them.
