Bev has a 501(c) which is required by LAW not to "intervene" in a campigne

Congress also found that existing audit and enforcement procedures were not sufficient to
deter an IRC 501(c)(3) organization from flagrantly violating the political campaign prohibition.
Therefore, it enacted IRC 6852 and IRC 7409. IRC 6852 provides that if such a violation occurs,
the Service may immediately determine the amount of income and IRC 4955 tax due from the
IRC 501(c)(3) organization. IRC 7409 grants authority to the Service to seek an injunction against
an IRC 501(c)(3) organization that flagrantly violates the political campaign prohibition to prevent
further political expenditures by the organization.
B. General Issues
An organization will not qualify for tax
exemption under IRC 501(c)(3) unless it "does not
participate in, or intervene in (including the
publishing or distributing of statements), any
political campaign on behalf of (or in opposition to)
any candidate for public office."5 A determination
whether an organization has participated or intervened is based upon all of the relevant facts and
circumstances.

1. If she does not assert the independence of her organization
Then I think she would be accepting a de-facto association with the Democratic Underground.

She risks loosing her tax exempt status and having to pay penalities.

but did she have to be so damn nasty to people she supposedly wants a working/friendly relationships with? That makes so sense to me.

6. It's what I've been trying to tell them.
They're not listening. Bev is an independent auditor. And DU put her in jeopardy and is doing it once again.

10. BBV and Black Box Voting predate Bev's 501(c)3 by a couple years
I can't see how this is a DU caused problem. There is no record of a "black box voting" in the USPTO tradmark database either. That cat is out of the bag.

Why did she want to go on the show if she couldn't intervene? No flame, just curious.

5. When I read the IRS regulations that govern her Non-Profit
I had a few choice words. *%%$#$^

With the level of scrutiny that she must be under she is skating mighty close to the wind.

She is allowed to campaign for clean, transparent elections and good government, but she is not allowed to "intervene" on behalf of any candidate for public office.

She has to keep reinterating that she is non-partisan and just wants an accurate count of the votes the electorate cast.

7. So, it actually seems she has some
room to manuever, then. It's late, and I'm tired, but she could certainly go on and not mention anyone's name. Telling everyone she's fighting for fair elections is great. Any proof of anyone supressing or manipulating anyone's vote (for ANY party) is a bad, bad thing as we all know here. She served the papers because Butterfly LaPore didn't want to comply with a FOIA request. That's non-partisan.

I hope she does go on and talk about what she's found. She can stay as high up out of the muck as she needs to be and no one would push her to violate any legal limits she has.

Just my opinion. I'm for all and any truth coming out, no matter who benefits. I want to know that the vote I cast was counted fairly and truly. That's my goal here, not Kerry. But he would be a huge bonus.

It could be used as evidence against her by Republicans who want to tax the organization out of existence.

9. I think that is correct, but she also could not allow a Partisin Board to
Use here trademarked group name, or she would risk being shut down immediately.



the IRS has let companies get away with murder recently, but when have the Rthugs been shy about using the law ON anyone crosses them.
