Friends,

As you know, we are in DC lobbying our allies on the Hill this week. Our
grassroots have made it clear that their main issue of concern right now is
the election recount and potential fraud in Ohio. We took that message from
you at the grassroots to our meeting with staff in Conyers' office.

Conyers' staffers put us in touch with the folks who pushed the Government
Accountability Office (GAO) investigations. We also left with the press
release you'll find below; they specifically requested that PDA get it out
to our base. Next was a visit with the Minority Legal Council, who informed
us about hearings on the irregularities in Ohio being held by the House
Judicial Committee this Wednesday. Conyers' staff has invited PDA to attend
these hearings on the Hill on behalf of the thousands of grassroots
activists who have been writing us and asking PDA to put pressure on the
Democrats. Rep. Conyers and his staff have been allies all along. We will be
coordinating efforts to assure your voices are heard during these hearings.

Voter Suppression: STEALING VOTES IN COLUMBUS

The Free Press on Election Day posted a disturbing story, later confirmed by the Columbus Dispatch. The Free Press reported that Franklin County Board of Elections Director Matt Damschroder deliberately withheld voting machines from predominantly black Democratic wards in Columbus, and dispersed some of the machines to affluent suburbs in Franklin County. Damschroder is the former Executive Director of the Franklin County Republican Party. Sources close to the Board of Elections told the Free Press that Damschroder and Ohio’s Secretary of State Kenneth Blackwell met with President George W. Bush in Columbus on Election Day. The idea was to discourage turnout in Democratic wards by forcing voters to wait in long lines at the polling places. Such a strategy would be far more effective than encouraging turnout in Republican wards. Elections are all about margins. There are 74 wards in Columbus. George W. Bush won 12 wards, with a margin of 7.35%. John F. Kerry won 62 wards, with a margin of 37.62%. Affecting Kerry’s turnout would greatly reduce his margin of victory in Columbus, giving the Republicans a much better chance of overtaking Kerry given a strong enough showing in suburban and small town Republican strongholds.

In order to investigate this matter, I obtained from the Franklin County Board of Elections all the data I needed in order to calculate, ward by ward, and precinct by precinct: (1) The ratio of registered voters per voting machine. (2) Percent turnout, calculated as total ballots cast divided by the number of registered voters. (3) Percent for Kerry, calculated as votes cast for Kerry divided by votes cast for president. (4) Margin of victory or defeat for Kerry, calculated as the difference between the vote totals for Kerry and Bush.

All 36 of the wards at the bottom of the list of voters per voting machine were won by Kerry, and they include most of his strongholds. In 29 of the 36 wards, Kerry exceeded his city wide share of 62.22% of the vote. However, these wards suffered a low voter turnout.It is important to understand what these numbers mean. The polls in Ohio were open from 6:30 A.M. to 7:30 P.M. That is 13 hours, or 780 minutes. If there are 400 registered voters per voting machine, and turnout is 60%, each voter has less than 3.5 minutes to vote, and that is assuming a steady stream of voters, with no rushes at certain hours. It also assumes no challenges to voters at the polls. If there are 550 registered voters per voting machine, and the turnout is 60%, each voter has 2.4 minutes. All of this amounts to theft of votes. It has been shown above that the Kerry precincts enjoyed a voter turnout similar to that of the Bush precincts when supplied with enough voting machines.

Thus I conclude that the withholding of voting machines from predominantly Democratic wards in the City of Columbus cost John Kerry upwards of 17,000 votes. A more detailed calculation could be done on a precinct by precinct basis, but that is not necessary here. The purpose is to illustrate the magnitude of the conspiracy. Matt Damschroder did not act alone. There are 74 wards and 472 precincts in Columbus, Ohio. It is not possible for one person to have delivered all the voting machines, and it is unlikely that nobody else was involved in planning where to deliver them. Anyone who associated with Mr. Damschroder on or shortly before Election Day should be investigated for possible complicity. Last year I spoke to a very nice woman in his office. She was so upset because all she gets are phone calls from freepers tearing him apart most of the time. I told her what freepers were because she had never heard of the term. She was very appreciative of any words of encouragement that people can send their way.

The Members wrote to Blackwell:



"Collectively, we are concerned that these complaints constitute a troubled portrait of a one-two punch that may well have altered and suppressed votes, particularly minority and Democratic votes. First, it appears there were substantial irregularities in vote tallies. It is unclear whether these apparent errors were the result of machine malfunctions or fraud.



Second, it appears that a series of actions of government and non-government officials may have worked to frustrate minority voters. Consistent and widespread reports indicate a lack of voting machines in urban, minority and Democratic areas, and a surplus of such machines in Republican, white and rural areas. As a result, minority voters were discouraged from voting by lines that were in excess of eight hours long. Many of these voters were also apparently victims of a campaign of deception, where flyers and calls would direct them to the wrong polling place. Once at that polling place, after waiting for hours in line, many of these voters were provided provisional ballots after learning they were at the wrong location. These ballots were not counted in many jurisdictions because of a directive issued by some election officials, such as yourself.



We're sure you agree with us that regardless of the outcome of the election, it is imperative that we examine any and all factors that may have led to voting irregularities and any failure of votes to be properly counted."



Among other questions, the Members asked Blackwell to respond to the following:



* Why did Warren County officials exclude members of the press from observing vote counting on election night, claiming an FBI agent had warned of a terrorist threat that was a "10" on a scale of one to ten, but the FBI has no knowledge of such a warning?



* Why did precincts in Perry County apparently record more votes than voters?



* Why did Butler County and a number of other counties record more votes for an underfunded Democratic candidate for State Supreme Court than were recorded for the Democratic Presidential candidate?



* Why did historically Democratic precincts in Cleveland record up to twenty-two times more votes for the Constitution Party Presidential candidate than all third-party candidates combined received in the 2000 election?



* Why did voters in Mahong County report that when they attempted to record a vote for John Kerry their vote was displayed as being cast for George W. Bush?



* Why did there appear to be a shortage of voting machines in traditionally Democratic precincts on election day, causing up to ten hour delays for voters, while there was an apparent surplus of voting machines in traditionally Republican precincts?

This is a major event as all of you know. Since I'm new at DU is there a way for you, jamboi and pointsoflight to cross-link your threads so that they are all visible and the comments in one are readily available to all of us?

And, earlier this evening, I saw a sentence appear that I have been waiting 4 weeks and 1 day to see -- "Did Bush Know?"

I have fond memories of our life in DC between 1971 and 1979; very fond memories of the first of the, now, 34 years we've been together and our wonderful apartment in Georgetown that happened to be directly across the street from one of Nixon's boys. And, I remember those first "Did Nixon Know?" murmurings.

Ah yes, as we had our dinner this evening celebrating the 34th year together we both toasted the first glimpse of the "Did Bush Know?" meme that appeared just as we were leaving for our little celebration.

It's going to get intense everyone -- get ready to jump on that steamroller and stop the paving of our democracy.

This time around, let's make sure that no one, decades from now, will ever experience one of those "Did xxxxx know?" moments. Our franchise is resilient, but it can use a long period of being cherished and nurtured.

And, just start asking and tagging everything with that simple little sentence "Did Bush Know?"

The 2004 National Election is not over and is not valid; a truly fair and valid National Election that chooses the 44th President of the USA is just beginning to show first light on the horizon. Be prepared to bask in it's glow.

We will prevail.

73. Robert Wexler, Boca Raton, one of 3 authors of GAO letter
and was one of the three original signers of the letter requesting a GAO investigation into the fiasco we call the 2004 election. Mr Wexler had made several brave attempts at the legal system, both in Florida and in the HAVA - to get a requirement for paper ballots. Jeb fought the Florida lawsuit saying that since Florida had had 2 "successful" elections - 2002 and 2003, that the machines were reliable and didn't need to have paper capability. Can you believe that??? I have to look up to see who that judge was. There was another activity in Congress to add the paper requirement to HAVA was stalled by Frist and repugs. Gee, I wonder why did the repugs in Congress stand in the way of a paper trail?

Did shrub know? Who, that is a repug, didn't know?

Mentioned in the Judiciary Dems' letter to Blackwell is Auglaize County. At the bottom of page 5 the Judiciary Dems' express puzzlement that Dem State Supreme Court candidate Ellen Connally received substantially more votes than Kerry did in certain counties. She was reportedly not expected to do well against her more heavily funded opponent.

There was an incident prior to the election involving Auglaize County, but first let me show the final updated tallies for Auglaize County:

Bush 17,012 (73.87%)
Kerry 5,904 (25.64%)
Total votes cast: 23,031

Moyer 11,795 (60.99%)
Connally 7,545 (39.01%)
Total votes cast: 19,340

So apparently, even though there were 4,000 less votes cast for the Supreme Court race, Connally received 1,641 votes (128%) more than Kerry.

Two weeks before the election, there was an incident of tampering with a voting machine in Auglaize that was reported in a local newspaper. Here's the relevant paragraphs:

In a letter dated Oct. 21, Ken Nuss, former deputy director of the Auglaize County Board of Elections, claimed that Joe McGinnis, a former employee of Election Systems and Software (ES&S), the company that provides the voting system in Auglaize County, was on the main computer that is used to create the ballot and compile election results, which would go against election protocol. Nuss claimed in the letter that McGinnis was allowed to use the computer the weekend of Oct. 16.

Nuss, who resigned from his job Oct. 21 after being suspended for a day, was responsible for overseeing the computerized programming of election software, according to his job description. His resignation is effective Nov. 11.

So it seems that a former ES&S employee was caught tampering with the machine that compiles the election results. I have found no further information about this incident.

I have posted this info before, but let me repeat it here. The name McGinnis pops up a lot when reading about ES&S. There are at least four of them. Dan McGinnis is a VP of ES&S. http://lists.electorama.com/pipermail/election-methods-electorama.com/2001-September/006610.html

There is also a Keith McGinnis. Three of the four McGinnis's were at this meeting in Indiana. http://www.in.gov/sos/elections/iec/minutes/min12799.html

So Joe McGinnis, who was caught tampering with a computer in Auglaize County, Ohio a couple of weeks before the election, is not just any employee. Apparently, he's related to top management.

The Evening Leader's article describes Joe McGinnis as a former employee. I'd like to know why that is. Also, Ken Nuss, who disclosed the tampering, was suspended for one day and subsequently resigned. What's up with that?

I have seen no further reports about this incident. It may very well be much ado about nothing, but it should be looked into, especially in light of the Connally issue raised in the Judiciary Dems' letter. It would be great if either you could follow up on this, or pass the information on to the Judiciary Dems' kick-ass staff.

BTW, the Dem staff's work on this is amazing. I've been following the election fraud issue quite closely, but there was much in the letter of which I was unaware. Thanks for posting the link to the pdf.

That is such an OBVIOUS choke point for suppressing the urban, poor, and minority vote!

Why wasn't there a numerical request made to Blackwell for adequate voting machines per capita or registration count BEFORE all this fraud?!?

How frikkin' obvious is THAT? So much fraud could have been PREVENTED instead of waiting to address the scam after the fact!

But despite the SOS and that Dammshroeder guy's statements to the contrary, I have yet to see any evidence that the 'democrats' on the election boards had any say in the distribution of voting machines. The Repubs make a big show of the bipartisanship of the election boards, but seem to shy away from detailing the responsibilities and power of those members.
In which case, maybe nobody but the Repubs even knew about the distribution. Seems implausible...
Anybody talked to any of these democrats?

79. Bingo - It was by intent, and not just in Ohio
Long voting lines was a very common occurrence in Florida - especially in the poorer minority areas. Even in spite of early voting, many many people stood in lines for several hours to vote. I'm sure that you will find this problem being referenced in many states if you look into the allegations documented in the GAO letter. There are 57,000 issues brought to the GAO for investigation.

Repugs did not want to prevent any of these civil rights violations since they got away with it in Florida in 2000. Florida was reprimanded by the Civil Rights investigation that occurred once shrub had been anointed. It came out in this investigation that Katherine Harris had paid over $1M for the "felons list" that contained 58,000 names and was 95% Wrong. The list was used to remove people from the voters rolls - over 50,000, by directive from Katherine Harris. When the Civil Rights report came but there were such whining about partisanship, virtually no immediate remedy was instituted. Like dethroning the shrub.

That's why it's important to get to the remedy for this election, before the coronation of shrub II. If they keep getting away with it, it will be a very long time before there will be fair and honest elections again.

I have been a fan of your work for several years - thank you for helping me to keep what little sanity I have left.

This letter to Blackwell is hugely important - look at all the signers! For the first time, it seems like the Dems in Congress are going to gain some strength in their solidarity. Maybe this is a result, partially, of all the letter writing to Congresspeople being done by plain folk like us. And with all of us spreading the word and making news, this has going to be a lot more powerful.

I bet that Blackwell gets left holding the whole enchilada himself. I don't get the feeling that he's as well protected as Katherine Harris was.

Perry, that's funny. I noticed that voter registration surged 30% between 2000 and 2004, while the population grew at only 4%, so there was a net increase of 26% in voter registration. The largest in the state. The voter turnout, adjusted for population growth, increased by only 14%, which is very average. Also, the shift toward Bush was not much greater there than in surrounding counties. So the voter registration numbers are funny but it didn't translate in statistical anomalies in the voting result - unless all the surrounding counties are also an anomaly!

I don't know if I'm reading it right: Does it mean that same-day registration was ok before 1978, and they were voting on rescinding it?
