Anyone know Arnebeck's plans for the lawsuit?

Anyone know Arnebeck's plans for the lawsuit?
According to the Alliance for Democracy website, "And on Wednesday, lawyers from the Alliance for Democracy, a group based in Massachusetts that advocates fair elections, plan to ask the Ohio Supreme Court to throw out the election results and declare Mr. Kerry the winner."

Originally, I heard it was going to be on Monday or Tuesday. I haven't been able to find any news about it yet, which suggests they haven't filed anything yet.

Does anyone know when (or if) Arnebeck is going to file something with the Ohio Supreme Court?

3. Wish I Knew....
Just heard a piece on local radio in Columbus about how the lawsuits--the recount ones as well as the contest of election one--that are threatened just keep getting pushed back and not filed. I wish I knew what was going on....

Two, one a witness, and one an attorney, said they were filing Thursday, tomorrow!!! I believe Arnebeck said so!!

From everything I've been able to find, Arnebeck is basing his case on 4 counties in southern Ohio (Butler, Clermont, Warren, and Hamilton). His claim is that 65,000 votes were switched from Kerry to Bush in these four counties. These counties together account for more than a 130,000 vote edge for Bush (more than his entire margin in Ohio).

Look at the thread above, however. I can't see how that case can possibly hold water. I asked if anyone had any additional information about other evidence he might have... but if he has anything else he's keeping it very secret.

I watched the hearings today on CSPAN. They did not encourage me. I'm afraid that he doesn't have anything else and the delay in filing has been in the hopes something else would emerge.

Can anyone here in DU shed any light on this?

7. I fear the worst. Perhaps he came out so strong last week in hopes...

he seems to be going for statistical anomalies using multilevel statistical analyses

That report is what raised the initial questions on three of the 4 southern Ohio counties (Warren, Butler, and Clermont).

12. I wouldn't be surprised at all if....
He has other weapons in his arsenal besides statistics. He may just be using stats as a talking point for right now and not tipping his hand. My guess is he might have sworn affidavits from voters who experienced problems voting, video and/or pictures depicting voter suppression at polling places, etc., or maybe something even more interesting.

Or maybe I'm just a hopeless optimist...just keeping my fingers crossed.

He needs to show that 65,000 votes were flipped from Bush to Kerry. He has said that the lawsuit alleges exactly that, but the only evidence he has ever mentioned was statistical analysis in the 4 Ohio counties discussed above.

14. He may have multiple claims to his suit...
which might include the flipped votes supported by statistics and anything else he might have up his sleeve and, possibly, voter suppression, which is grounds for a lawsuit in itself.

16. It takes a lot of time to put a good complaint together
I am thinking that new information keeps coming to him that he wants to include, and there is a lot of last minute perfecting of the complaint. It is a lot of work to make certain affidavits are accurate and signed. People read their affidavits and have last minute additions or corrections. It is crucial that this be as good as possible, so I am hoping that the delay simply means he is making certain it is airtight before he files.

17. Will the statistical anomalies warrant an investigation and
analysis of the machines as part of the "discovery" process? I think that is what Arnebeck is going for.
