seems like vindictive childish crap--(I'm "non-partisan" on the Bev vs. DU issue and take no sides). All I can say is that the way *I even found DU was by googling Bev Harris. Yeah, she's made some mistakes, she's done some things I don't understand and wouldn't have done (and it's not like DU hasn't done things I'll never understand,either). Haven't we all had our moments, good and bad in this fiasco? And hasn't a lot of good come out of all our collective efforts? And will we ever learn to forgive, forget, try not to sweat the small stuff and FOCUS on priority number 1 (i.e. OVERTURN ELECTION)? In other words, don't we all have far more important business to tend to?

the "cleaning crew". They're cleverly called that because they are a "crew" that does a lot of "cleaning". They've been called that for at least ten years. Just one little word off, but has the same alliteration.

How can anybody copyright phrases or terminology that are already in the everyday lexicon of the average person?

I can't believe I'm posting on this topic; just trying to get to 300.

And btw, I have NO interest in TM'ing any stupid clean up crew name, but thought DU might. I don't even think you could get it now anyways.

Besides, maybe the Hand Soap company will go after BBeV, since she is using their mark, and claiming it is hers...

You might want to think very hard about making any more unsubstantiated allegations about Bev or BlackBoxVoting.org "profiting off donations" or her "selling" items that her PR firm handled. Be prepared to prove your allegations. :)

19. Doesn't work that way. She's been using it for an extended time and that
is easily demonstrated. Legally she has an excellent standing even if she hasn't formally trademarked, servicemarked, copyrighted, etc. Besides, why would we want to stir up more bad blood? Don't we have the creativity to come up with another decent name ourselves? We need to work together not pick fights with others working on election fraud.

As far as your question about registration, it is her nonprofit that is "registered". Bev demonstrates that in post 4 of the controversial thread, where it states:

"Black Box Voting, Inc. - a registered 501c(3) nonprofit corporation".

So it appears the notions of nonprofit "registration" and trademark "registration" have been confused. Moreover, the corporation name becomes a common law trademark by defacto.

Here is the post from the thread where Bev explains the cause for concern about misuse of her nonprofit name:

People are currently donating funds to the BBV Cleanup Crew (the real one, which is registered to us) for specific actions like a Florida recount and FOIA requests.

When someone else uses the same name, it confuses things rather badly, and also mucks up the message. We are doing some very specific things. That's not to say these other things aren't important, but they shouldn't call them the same thing.

Just think: Suppose I started posting on DU a call to join a MoveOn effort that MoveOn knew nothing about, or suppose I wanted to do something under the name PFAW Election Protection, without first getting permission from People for the American Way and their related entity, Election Protection.

This is not something that lends itself to opinions. It is legal stuff, and those of us who are protecting nonprofit 501c(3) charters know how touchy it can be to say the wrong thing under the name of the nonprofit.
