What letter did Kerry send to 88 Ohio Electors?
Edited on Sun Dec-12-04 08:01 PM by Diane R
I am listening to AAR. The hostess has just referred to a letter that Kerry sent today to 98 electors from Ohio. Does anyone know about this? It sounds like a very positive move.

Wouldn't that mean Bush wins by 54 more votes?

And wouldn't it ALSO mean that if Ohio DOES end up in Kerry's column at some time in the future that he STILL wouldn't win?

edit: ok, a caller just asked about this; the idea they are talking about is that the scanners read the cards upside down (or something)

13. 88 Boards of Elections, not 98 n/t
Edited on Sun Dec-12-04 07:47 PM by Stand and Fight
93,000 spoiled ballots.

Judge C. more votes than Kerry in Southern Ohio. Votes for Kerry possibly came up for Ellen Connaly -sp?- on optical scanner machines.

Poll workers didn't instruct voters to cast their ballots on the right machines.

Jackson and Kerry drafted a letter to be mailed Monday to 88 separate BOEs. Inquiring about possible misplaced votes in southern Ohio for Judge C. and provisional ballots and auditing of machines by non-partisan personnel.

Different standards are being referred to by the different BOEs -- not the ones set out in Ohio election law. That is, 3% and if the numbers don't match then full hand-recount.

14. Kerry Letter.....
to 88 Board of Electors Directors..That Kerry was calling for investigations into distribution of voting machines. Jackson and Kerry together drafted a letter, (1)pointed to 92,000 ballots where no votes were counted for president; (2) Some outside independent verification of the optical scanners of paper ballots; (3) Provisional Ballots: The level of votes that were rejected were twice the amount as in 2000, another anomaly, to be investigated.

16. 88 Board of Election Directors....
Not "electors."

Letter goes out tomorrow.

"Involve numbers large enough to change the outcome."

92,000 votes cast with no vote for President.

Judge who got 200,000 more votes in certain Counties than Kerry.

Kerry calls for non-partisan audit into optical scanners.

Will the op scan paper ballots be counted independently of scanners?

Provisional ballots -- different standards used in different counties.

284. he's not a christian at all. I think it was Billy Graham (sp)
that said even though shrub claims that it was Billy who "saved" him, Graham says that he never felt that he at any time made any impression at all on that shrub.
Also during the election, the pbs station where i live was running a story compairing Kerry & shrub. They showed shrub in his early days watching his father campaign. He was more or less noticing how if you got the religios people on your side that they would do the work for you. They said shrub was saying "i could do that, I could do that down in Texas"
To me he was very much in that documentary learning how to manipulate the Christians. I don't think he's any kind of Christian.

281. WBNS-TV: Kerry Reps Have Specific Questions About Ballots
http://www.10tv.com/Global/story.asp?S=2682826

Columbus OH TV pickup of story:

"A lawyer for Democrat John Kerry is asking county elections officials to allow his witnesses to visually inspect the 92,000 ballots cast in Ohio in which no vote for president was recorded.

Donald McTigue is the lawyer handling the recount for the Kerry campaign.

He says the Kerry campaign sent a letter to Ohio's 88 county boards of election over the weekend detailing eleven items that Kerry is asking for as part of the recount that the boards will begin this week." (more at the referenced URL; posted at the TV website in the past hour).

19. calling for investigation of allegations
Kerry evidently has drafted a letter to send to , 88 counties, (88 board of elections )--

involved numbers that potentially could change outcome.

1. 92,000 votes not counted (spoiled ballots) --

2. Judge (conally) -- got 200,000(?) more votes

looking for non-partisan investigation of software.

3. Provisional ballots -- different standards for these. The level of votes rejected were twice the number of votes rejected (though there weren't used in 2000 -- but twice the number of the ballots rejected)

(Sounds like they are asking for each BOE to answer the questions that Blackwell didn't).

303. I think you mean Undervotes, not Spoiled ballots
Undervotes are where the ballot is good, there is just no vote for the particular office, in this case, no vote for President.

A spoiled ballot is one that should go in the trash, but has to be counted just to make the count of ballots come out right.
Precinct is issued 100 ballots, they need to return 100 ballots. If someone says I made a mistake, may I start over, A fresh ballot is issued and the ballot with the mistake is said to be spoiled.

So let me get this right.

I was right all along? Really? I'm not psychotic? I felt all along that things were going to plan. Just a nagging feeling all the time that everything was supposed to happen when it was supposed to happen, and not a moment before.

I knew that the man that took down BCCI and Iran-Contra had a plan. Wow. I'm gonna go get a drink. Come on, they're on me! :)

210. My first clue wasn't even Kerry, per se...
it was the fact that Wesley Clark steeled into the Middle East for two weeks (and is still there) and didn't mention why he was there.

I know he's at some three-day symposium with The Big Dawg in Dubai, but that doesn't take two weeks...

I always thought Clark would be State or NSA or some sort of security advisor for Kerry. I knew the gig wasn't up when I heard Clark was there. I knew Kerry was doing some research and that his "shadow cabinet" was still, well, "shadow cabineting."

I haven't finished reading this thread - is the Kerry/Jackson letter available anywhere?

292. Here's the quote:
I included it in some of my Christmas cards:

"A little patience, and we shall see the reign of witches pass over, their spells dissolve, and the people, recovering their true sight, restore their government to its true principles. It is true that in the meantime we are suffering deeply in spirit, and incurring the horrors of a war and long oppressions of enormous public debt......If the game runs sometimes against us at home we must have patience till luck turns, and then we shall have an opportunity of winning back the principles we have lost, for this is a game where principles are at stake."

298. The Quote
The quote is as fitting today, as it was when Thomas Jefferson said it in 1798. Did you say Elizabeth said it? Jefferson said it first. I used the quote too, and had a lot of commnets about how
"erie" it was when you read it thinking it is a quote made for today. It is very old, but still fits.

27. 3 points from letter according to Flander's guest (Bonifaz?)
1) 92,000 votes not counted
2) Optical scanners vote shifting? request nonpartisan observers
3) Each county handlig provisional ballots differently

Appearently Kerry had a conference call w/ Jackson & Arnebeck and drafted a letter to go out tommorrow.

seems to me that this is kerry announcing what he considers to be his minimal standards for the recount, and that, if these are "abrogated" that he will be fully justified to take "further measures" (perhaps "serious consequences" may be inferred as well) in the form of the redress which a post-recount legal process may afford him

65. November 16 Columbus Free Press Reported on the unused Machines
but MSM is just now picking it up (the # has changed, though)

"One telling piece of evidence was entered into the record at the Saturday, November 13 public hearing on election irregularities and voter suppression held by nonpartisan voter rights organizations. Cliff Arnebeck, a Common Cause attorney, introduced into the record the Franklin County Board of Elections spreadsheet detailing the allocation of e-voting computer machines for the 2004 election. The Board of Elections’ own document records that, while voters waited in lines ranging from 2-7 hours at polling places, 68 electronic voting machines remained in storage and were never used on Election Day."

99. Not entirely true
If the election can be proven to have been handled so badly that it's impossible to say it reflected the will of the voters, there can be a revote. I think that's part of what contesting an election is about, which I think is where we're at in the process.

that the Constitution has the mechanics in place for a revote. That's the one scenario that I'm sure isn't happening.

If Ohio is screwed up, they'd just send two set of electors, and congress would decide. I wonder which set the Republican controlled congress would accept?

If the Republicans in Congress try some funny business with electors even though the People have spoken...I'll personally be conducting daily protests...and I hope all of you will take to the streets too..

They can't win if we do a Ukraine here...I don't care WHAT the Constitution says on Electors....the People rule!

314. That's exactly what Arnebeck said on Randi Rhodes on Friday.
He said that he FIRMLY believed that if evidence of Fraud was shown (via his lawsuit), that 'the people' would NOT tolerate the current election results. He said he believes in the will of the people that much.

The Civil Rights Act of 1964 gives all Americans another reason to be proud of our country. The work of equality is not done because the evil of bigotry is not finally defeated. Yet the laws of this nation and the good heart of this nation are on the side of equality. And as Dr. King reminded us, "We must not rest until the day when justice rolls down like waters, and righteousness like a mighty stream." - W

100. I've been skeptical of this whole voter fraud
story, but this is making me a believer. What we need to realize is that the crashing wave of the right-wing media is about to come full steam on us. Up to this point it was an underground movement, now its mainstream. Everyone needs to realize that this is going to be a very bumpy ride, and we need to pressure the media accordingly.

Most of us here, whether believers or skeptics, are no strangers to the idea that the 2004 election may have been fraudulent. If this hits the mainstream in a big way tomorrow it will be hitting most people completely out of the blue and things could get pretty ugly as a result...

235. lateo, you must not have much faith in John Kerry. Did you vote for him?
I did vote for him and I KNEW he would not let the Republicans steal another election. NO political party should be allowed to get by with stealing elections and controling our country like this bunch of lying conning crooks have done because this is nothing more than a dictatorship and Bush is the top DIC and every damn one to them need to spend their remaining days behind bars!

192. Jackson/Kerry phone tag
Edited on Sun Dec-12-04 09:10 PM by jmknapp
Thing is, at his speech in Columbus a couple weeks ago Jackson mentioned speaking with Kerry by phone about such matters, but that didn't mean that Kerry had officially endorsed anything. The letter based on what is posted here sounds more like Jackson/Arnebeck talking points than Kerry talking points. For example,to allege that there are enough miscast votes to overturn the election results goes against all Kerry has been saying for weeks.

What is the probability that the letter will include Kerry's signature?

127. Kerry letter to us
When the road gets dark
And you can no longer see
Just let my love throw a spark, baby
Have a little faith in me

When the tears you cry
Are all you can believe
Just give these loving arms a try, baby
Have a little faith in me

Have a little faith in me
Have a little faith in me
Have a little faith in me
Have a little faith in me

When your secret heart
Cannot speak so *easily*
Come here darlin'
From a whisper start
To have a little faith in me

When your back's against the wall
Just turn around, you will see
I will catch ya, I will catch your fall
Just have a little faith in me

Have a little faith in me
Have a little faith in me
Have a little faith in me
Have a little faith in me

Well, I've been loving you for such a long, long time baby
Expecting nothing in return
Just for you to have a little faith in me
You see time, time is our friend *for you and me*
Cause for us there is no end
All you gotta do is have a little faith in me
I said I will hold you up, I will hold you up
Your strength gives me enough
So have a little faith in me
Hey baby, oh, baby
All ya gotta do is have a little faith in me
All ya gotta do is have a little faith in me
A little faith in me

166. Unlikely
There's no legal remedy that allows for doing part of a national election over again. The best that could happen would be for Ohio's Republican electors to be so horrified that they vote for Kerry. Can you say unlikely? I don't think you'll see a Democratic slate of electors in Ohio.

Now say Kerry was declared the "winner" and was somehow inaugurated as President. Imagine the mayhem. The shit that Clinton went through would seem like a bubble bath compared to what would happen to Kerry.

The very best outcome would be an expose that makes Watergate look like shoplifting a pack of gum compared to the systematic election fraud committed by Republican operatives directed by the Bush/Cheney reelection committee with direction from the big guy(s). Never happen. They're not that careless.

209. If Kerry proves he won the popular vote
The State of Ohio MUST change its slate of electors to reflect the result of the popular vote. It's in the State Constitution that's how the slate will be elected. The State of Ohio CANNOT change the way it chooses its electors AFTER election day. Before, yes. After, no. It would be a violation of the United States Constitution. Don't let anyone tell you differently.

There is no Constitutional authority for sending a Republican slate if the method by which the legislature chose to elect its slate hinged on the outcome of the popular vote and that popular vote margin went Democratic.

Yes, I know what the Florida legislature threatened in 2000. It was unconstitutional.

Read Boies new book, the chapter on Bush v. Gore. This is a black and white issue, not open to question.

I heard the LF show. There was talk of the letter with the 11-point plan. There was also talk of the letter containing a request for election officials to testify under oath.

Edit: I remember something else that was discussed. Jesse Jackson talked to Kerry personally(via phone I believe) and TOGETHER THEY DRAFTED THE LETTER. It will be sent out tomorrow.

265. I love hearing freepers saying things like this...
"If that happened, you can bet there would be a full investigation by the gop as to where these votes came from, where they were all this time, do they match up with the registration numbers, etc etc etc. There would be a million questions and unless there were rock solid, SANE answers to them, they would be deemed as fraudulent and rightly so."

and

"Watch the 'rats very closely on this one. If they and their lawyers keep picking at this, it could blow up in our face."

These statements among themselves (if we can assume that;) reveal how tenuous they know their situation to really be ... when such concerns are voiced, you can sense the psychic wheels quickly spinning into Votergate Nightmars Zone.
In a weird way, this gives me hope.

227. PEOPLE, PLEASE CONFIRM WITH MORE DETAIL--ALL WHO HEARD IT!
I'm dying here!

1. Just a couple of people upthread heard this. Did they hear right? ALL WHO HEARD IT, PLEASE POST HERE!

2. I caught just the tail end of it. There were TWO GUESTS, both male. One was Steve Rosenthal (of AAR). The other? Bonifaz?

3. DID THEY SAY THAT KERRY SIGNED THE LETTER??? If so, this is big, big, big--as to potential nat'l news coverage and public consciousness. This will be Kerry's first official involvement, in person (not just K/E campaign in the process lawsuit). But if it was just a phone conference with Kerry--then it depends on these guys' word. I'm sure they wouldn't lie, but it makes a critical difference on coverage. What EXACTLY did you hear them say about this? Will the letter go under Kerry's SIGNATURE? Did they say "letter FROM Kerry"?

I cannot tell you how happy I am just to hear that Kerry is advising them, and is aware of the evidence and following things closely. But if this is true--that HE is sending the letter--I will be ecstatic!

And I don't care if we win or lose! There is a wild ride ahead! Look out! But what it means is that we may have a champion--in addition to all the heroes we already have! Someone with a lot to lose willing to stand up for our right to vote!

Secondly, it may save the Left and the Democratic Party, keep us together, keep us unified, save our great coalition of grass roots and Dem leadership, give us hope and reason to go on--win OR lose. It doesn't matter. If we don't have to fight the Dem party, then we might be able to save our democracy in the end!

And something else that's really, really, really, really important is that the news about this election get to KERRY VOTERS--the majority! Most don't know what happened! And national news like this is the only way they can find out quickly.

So, please, can we get clarification, and more detail and confirmation on what was said?

COLUMBUS, Ohio -- Democrat John Kerry is asking county elections officials to allow his witnesses to visually inspect the 92,000 ballots cast in Ohio in which no vote for president was recorded, a Kerry lawyer said Sunday night.

The request is one of 11 items that Kerry is asking for as part of the recount that Ohio's 88 county boards of election will begin this week, according to a letter sent to the boards over the weekend.

"We're trying to increase the transparency of the election process," said Donald McTigue, the lawyer handling the recount for the Kerry campaign.

ambivalent line, although it may be that circumstances will force his hand. I heard the main part (see 3 points post above), but would like a transcript.

252. does the show replay?
or does it get archived immediately somewhere online?

I heard it, but was so stupid to not start recording it.

I was multitasking at the time, so wouldn't sign an affidavit about what I heard, except I do recall Flanders making the point that "the post office doesn't work on Sunday" and so the comment that the letter would be sent today must mean that it will be sent tomorrow.

The first guest who was on, was it Jackson? If so, that's more or less the horse's mouth, if he co-drafted the letter.

The question really becomes: did Kerry actually sign the letter, or is it coming from one of his attorneys?

256. I heard it as well...
If I remember correctly, it was Jesse Jackson at the beginning of the hour that first mentioned the letter that he had spoken with Kerry about and that was coming out tomorrow. Flanders seemed just as floored as you all are. I'm just trying not to get too excited...but I DID hear the part about it being enough votes involved to change the outcome...although I don't recall who said that...it was all coming so fast and furious!

My son has agreed to eat humble pie if it is true.

I was told a long time ago (November 3, 2004 a life time ago) this was a Trojan Horse strategy to wait December 13 for the first move.

At this point I know how Cassandra must have felt.

Kerry is smart he would make an excellent President.

257. Something the Edwards said on Larry King
Larry King asked John and Elizabeth if she had heard from John Kerry (concerning her battle with breast cancer). They both looked at each other, and said that he calls 'every day'. At the time, I wondered if there weren't more reasons for him to call than to simply check on Elizabeth...although I am sure he wants to do that, too. Now I am thinking that it was probably a clue that John Kerry and John Edwards have been plotting strategy all along.

I also noted that the interview with John and Elizabeth was taped early in the day, and they did not take phone calls. Perhaps they did not want to have to answer any questions about election fraud?

But after getting slammed so hard in 2000 when the USSC got involved, I am just super doubtful that this will go anywhere.

I have NO DOUBT we won, Kerry was robbed BIG TIME, and the amount of fraud involved is beyond all of our comprehension. But I just don't see the MSM touching this AT ALL, nor do I see anyone in OH taking it seriously, true or not, and it won't matter if if JESUS HIMSELF wrote the damned letter.

I hope more than anything I am wrong!

is what they were referring to. John Kerry is requesting that his witnesses have access to 11 items during the recount according to a letter to the boards from the Kerry camp.

It is, indeed a positive move...the more attention this receives from the mainstream media, the better. I still don't understand why they're dragging their asses on this...makes no sense.

302. This is all wonderful, and there are some things we need to be doing..

We have to make sure they do a hand recount in OH!
From: http://www.stolenelection2004.com/alerts.html

The Green party is demanding a FULL recount and the Democrats are not sure if they will make that request yet. They might be satisfied with a 3% hand count and let the rest run through the same faulty machines! The local Ohio Boards of Elections different counties which makes the final decision will get "cover" if the Democrats are satisfied with 3%. For more info click here.

Tell the Dems that a full manual recount--and a full investigation of the voting machines-- is the only way to make sure every vote will count!

Contact: Contact the Ohio Dems 614-221-6563 (voice) 614-221-0721 (fax) email dan@ohiodems.org;
The DNC: Phone 202-863-8000 and http://www.democrats.org/contact

AND

This is a copy of a resolution that was passed by the Oregon Dems and sent to all our legislators: http://www.dpo.org/news/documents/1780.html

See particularly this section:

"We encourage and will support our elected officials as follows:

U.S. Representatives Earl Blumenauer, Peter DeFazio, Darlene Hooley, David Wu, and Greg Walden we encourage and support

-a public and aggressive participation, alongside Congressional Representatives Conyers, Nadler, Wexler, Holt, Scott, Watt, Baldwin, Miller, Slaughter, Filner, Lee, Meeks, Olver, and Schakowsky in calling upon the Government Accountability Office (GAO), to perform a timely and thorough investigation into all voting irregularities nationwide
-a public pledge to challenge the electors from any and all states where irregularities and possible fraud have surfaced

Senators Ron Wyden and Gordon Smith, we encourage and support

-a public pledge to step forward and concur with any such challenges to state electors brought by members of the U.S. House of Representatives

Americans need assurances that their elected representatives are working with steadfast determination to ensure every vote is counted.

Your efforts to this end may be difficult and will likely be challenged by those currently satisfied with the perceived election results. However, for those who believe that America's promise of "liberty and justice" and a counted vote "for all" MUST be honored, your efforts will be recognized as nothing less than heroic."

I suggest that everyone writes and calls their legislators and asks them for the same. They all need to know we support them in challenging and are requesting that they challenge the electors from any and all states where irregularities and possible fraud have surfaced. We need to do this asap so in the event that a recount or investigation shows Kerry won, or fraud is proved, our legislators know clearly what we want, and that we support them in any challenge.

There is also the Declaration of Intent Concerning Presidential Elecions http://thedeanpeople.com/ for legislators to sign, which ends :
"Therefore, in keeping with my oath of office, I publicly declare my intention to act on January 6th 2005 and object to any presidential electors that I believe to have been unlawfully appointed. To do less would make me complicit with a violation of our shared democratic principles."

There is also a pdf link to the Declaration of Intent at the bottom of
http://www.house.gov/judiciary_democrats/voteforum.html
which is the posting from the Conyers Forum last Wednesday.

Kerry Lawyer Seeks Ohio Ballot Inspection

15 minutes ago Politics - AP

By MARK WILLIAMS, Associated Press Writer

COLUMBUS, Ohio - Democrat John Kerry (news - web sites) is asking county elections officials to allow his witnesses to inspect the 92,000 ballots cast in Ohio in which no vote for president was recorded, a Kerry lawyer said Sunday night.

The request is one of 11 the Kerry campaign made in a letter sent over the weekend to Ohio's 88 county boards of election, which will begin recounting presidential ballots this week.

"We're trying to increase the transparency of the election process," said Donald McTigue, the lawyer handling the recount for the Kerry campaign. But he added that several requests — such as using independent experts to check election equipment, "are trying to push the edge of envelope."

Two minor presidential candidates who received 0.30 percent of the votes in last month's election requested and paid for the recount, claiming that the election was full of irregularities that need to be addressed.

President Bush (news - web sites), a Republican, beat the Massachusetts senator by about 119,000 votes in Ohio on Election Day. Ohio's 20 electoral votes, which will be cast on Monday, put Bush over the top in the race.

Kerry's campaign supports the recount, while Bush's campaign has criticized it, but both sides agree it won't change the outcome of the election.

McTigue said the visual inspection is allowed under state law. The goal is to look for potential votes that were not registered by the tabulating equipment.

McTigue also asked that counties accept the help of a group called Votewatch to determine which precincts will be chosen for the part of the recount that will be conducted by hand. McTigue said using the group will ensure that the ballots are selected using a valid random sampling method.

The procedures require 3 percent of ballots to be counted by hand in each county. All the county's ballots would be counted by hand if the initial check turns up problems.

Carlo LoParo, spokesman for Secretary of State Kenneth Blackwell, said state law will guide counties on how to conduct the recount.

"I don't know if Mr. McTigue is in a position to dictate the terms of a recount," he said.

I hadn't noticed this phrase being in the other versions of stories/releases (was it?). I mean, I know Kerry has said this in the recent past about the recount, but is it true that he has clearly re-stated this in current context of 'letter to OH BOEs'? anyone know.

304. Okay -- I have a question to ask...
When you check all the MSM sources -- and google and UK Guardian, the same press release information comes up...question me this, who put out the press release and how did it hit MSM so-o-o quickly???

Do you see where I'm going with this question? Where am I going with this question? I mean, we work our butts off getting election fraud articles to MSM and day after day after day...virtually zilcho. Now granted, once Kerry or his attorney's come alive, there's more to the story...but the question remains ???

She talked about the letter and the actions tomorrow.

This is my first post here. I've been lurking for a few weeks and reading the info where I could find it and watching Olbermann and talking with people about it, but had felt so up and down - hopeless one minute (mostly from the apathy of people who I knew cared deep down) and hopeful the next when I would talk to someone else who cared or when i would read posts here.

Glad to know so many other people care about justice.

My heart is jumping and I am so excited I can barely keep myself from a Dean Scream. This is going to be one of the best days of my life, thank you for the info.

328. "God Bless Us, Every One!"
Was watching the last line of "A Christmas Carol" right about when I found this thread, believe it or not. My agnostic husband has promised to go to church to say thanks if Kerry gets in!

329. Nothing on J.Kerry's web site and no link to any news
of this on Air Americas Web site.. If Kerry is going to jump in he should be at Rep Conyers thing today!!!!

Dont get our hopes up to be dashed again.... find something concrete like a copy of the memo
