The Kerry Letter
I worked with Donald J. McTigue on the Kucinich campaign. He was Dennis' Treasurer. He is now the counsel for the Kerry/Edwards Recount. As you know PDA (www.pdamerica.org) has been at the forefront of this fight in Ohio. This is THE letter Kerry sent to each county. We got this last night from Don directly, as an FYI, and Thank you. I wanted to share this with you all!

Peace,
Kevin Spidel
Deputy Director, PDA

Re: Presidential Recount

Dear Director and Deputy Director:

Enclosed please find a copy of a letter personally signed by John Kerry appointing me as his legal counsel with respect to the recount for President and Vice President of the United States, with full authority to act on behalf of him and John Edwards, including appointing witnesses to attend the recount. Also enclosed is a letter personally signed by John Kerry designating witnesses to attend the recount in your county.

On behalf of John Kerry and John Edwards I am making the following requests regarding the conduct of the recount:

The selection of precincts for the three percent hand count should be according to a scientifically valid random sampling method. I am aware that you have received a letter from Votewatch regarding this issue with an offer by that organization to provide resources to ensure that the sampling method is valid. We urge you to accept this offer of assistance or otherwise be able to demonstrate that the method employed by the Board to select the precincts for the three percent hand count is scientifically valid.

2. We request that each candidate be given the opportunity to select at least one precinct for a hand count, either as part of or in addition to the three percent hand count.

For those counties that use touch screen voting systems, we request that the three percent hand count include a hand count of three percent of the ballot images stored in the each of the redundant memories of the machines selected for the recount and on any paper trail for the machines.

We request that the Board provide the opportunity for candidates participating in the recount to have the programming and calibration of the tabulating system, scanners, and electronic voting machines verified by independent experts.

We request that the test used by the Board to verify the logic and accuracy of the computer tabulating program be performed for each precinct, including any separate absentee precinct. Further, the test should include testing for under and over voted ballots.

We request that computer printouts of the recount results include the under and over votes recorded in each precinct.

John Kerry and John Edwards hereby request to have their witnesses visually inspect all ballots for which your voting system has not recorded a vote for President and Vice President, i.e. the undervote and overvote ballots. If the Board does not agree to a visual inspection of these ballots, then we hereby request to visually inspect all ballots pursuant to R.C. § 3515.04 and OAG 74-103.

We request to inspect envelopes and related paperwork for all uncounted provisional and absentee ballots. This includes documents stating the reason or reasons that a ballot was not counted and the documentation to support the same.

In order to verify candidate rotation, we request to inspect the ballot page assemblies of all punch card voting devices and the ballot faces of all touch screen voting machines used at the polls or at the Board’s office.

For those counties where the names of Nader and Camejo were visible to voters on the ballots, ballot pages or faces of voting machines, i.e. where the names were not covered over with a sticker or blacked out or the ballots were not reprinted without their names, we request to know whether any votes were cast for Nader and Camejo for President and Vice President.

We request that absentee ballots which were postmarked by election day, November 2, 2004, and were received by the board no later than November 12, 2004, be counted if the voter did not vote at the polls.

The above requests are in addition to any other requests that may be made by our witnesses.

If you should have any questions, please do not hesitate to contact me.

Very truly yours,

cc: Daniel J. Hofheimer

Kerry-Edwards State Counsel, Ohio
Donald J. McTigue

This is an INCREDIBLE letter! It reallllllly shows the Kerry camp is definitely taking this matter very seriously!

I know the boards are going to refuse some of the requests, and I can't wait to see the heated replies from the Kerry Camp when that happens!

9. Asking that provisional ballots supercede absentees?
"We request that absentee ballots which were postmarked by election day, November 2, 2004, and were received by the board no later than November 12, 2004, be counted if the voter did not vote at the polls."

So in the cases where a poll voter was told they had already voted absentee, their provisional ballot will be counted instead of the absentee?

13. Sounds like they
are asking that absentee ballots that were _postmarked_ by the 2nd be counted. I don't know how it is in Ohio, but I believe most states the ballot has to be _received_ by the 2nd to count. Not just postmarked. Sounds like a bit of a stretch to me.

16. Florida
That was part of the stink over the military ballots and I think they made exception to include anything postmarked by the election date then. Maybe Kerry knows he got that absentee vote.

20. Kerry definitely won the absentee ballots, especially military. I'm sure
that's what this is about. And yes, * screamed bloody murder in Fla-la-la in 2000 to make sure military votes postmarked by the election date were included in the count (that of course was back when the military didn't know how he would use and abuse them in Iraq), so there is precedent for those to count in Ohio this time.

Saw in another thread that Cobb testified tampering by the company with the machines...they did this on Friday. *dons tinfoilhat*

Did this get garbled?

17. Incompetent lawyer? Point by pic is water-weak
Edited on Mon Dec-13-04 01:07 PM by oscar111
the unnumberred point, next to and a bit below the poster's sig pic, about point 5??....

is incredibly poorly thought out.

Just asks the BOE's to use THEIR BOE logic test of the BBVs, on every precinct's BBVs.

This adds no outside scrutiny to the whole mess. Merely asks the criminals now in charge, to do more of what they have been doing all along.

I think McTeague meant to write, that a new logic test for BBVs, from the recount candidates, be used on every BBV. But he instead wrote, THE BOARD'S TEST.

The lawyer who wrote Kerry's letter looks incompetent in this paragraph. IMO.

I hope i am wrong. Anyone?

19. Triad tech caught on tape? should we all carry picturephones all the time?
IF we all had picturephones.. whatever the right term is?..
we would be able to transmit such tech tricks whenever we happen upon them.

Even when unexpected.

Is there any phone no. that links to a site that will record the action as sent?

A tape of that tekkie in action, switching a part, would be priceless.

26. THANK YOU Kevin
This is great. This is just more proof that Kerry is involved with everything that is going on. There are many of us here that have said all along this man was a fighter not a quitter. Just because he wasn't in the spotlight jumping up and down and letting the repug idiots and the media know what he was doing didn't mean that he had just up and quit like so many around here were so quick to say. Kerry is a person of intelligence who can see all sides of an issue and incorporate all available data before making a decision. Kerry is on our side and always will be.

31. Well I hate to tell you but they are not honoring this request ..
I think it would be time to do more than request.

excerpt:

According to Mr. Thomas E. Wolfe, Chairman of the Medina County Board of Elections, "I took two Medina precincts because I knew they had a high vote." "I could have taken five precincts, but then we'd be counting for another hour."
